Former Trump Supporters Issue Cease-and-Desist to FOX News

The legal team representing the former Arizona couple Ray and Robyn Epps sent a cease-and-desist letter to FOX News and FOX News Channel personality Tucker Carlson, demanding they “stop making up lies about Ray Epps and that they offer an on-air retraction.” Ray Epps (a now former supporter of Donald Trump) was at the Capitol on January 6 has been a focal point of Carlson’s January 6 show content in which Carlson has labeled Epps an undercover federal agent and a provocateur of the riots. Epps’ attorney Michael Teter says, “For years, Tucker Carlson and FOX News have targeted Ray Epps with malicious lies about his involvement in the events of January 6th. FOX News has chosen to promote fantasy over fact, exposing Ray and Robyn Epps to harassment, intimidation, and abuse. It is clear that Mr. Carlson and FOX News are uninterested in speaking the truth to their viewers… Recent revelations from the Dominion Voting lawsuit make clear that FOX News has zero qualms about lying to its viewers. The fictional story that Mr. Carlson and FOX News have told, and continue to tell, about Ray Epps is just one more example of this. It is time for Mr. Carlson and Fox News to stop the lies and to make amends.” The Epps are demanding “that Mr. Carlson and FOX News retract the claim that Mr. Epps was working for the FBI or any governmental entity when he attended the January 6th events and the claim that Mr. Epps acted as an instigator or provocateur of the insurrection. We expect that you will give the same airtime in retracting these falsehoods as you spent amplifying them. Further, Mr. Carlson and FOX News must issue a formal on-air apology for the lies you have spread about Mr. Epps.” The Epps’ are also providing notice of potential litigation regarding what they call FOX’s “defamatory conduct.”

The Daily Dance of Affirmation

By Michael Harrison

TALKERS

Talkers Magazine - Talk radioThe embarrassing situation and accompanying financial vulnerability being faced by our colleagues at FOX News is a high-profile example of the consequences of audience “targeting” that has become the common positioning strategy in today’s competitive media marketplace.  The process is simple: You give the specifically targeted audience what it wants, not necessarily what it needs, even if what it wants is of dubious quality or unhealthy and – in the case of political talk media – untrue. It is a problematic, unsavory practice that has been brewing in our industry for years and, in the case of FOX, the proverbial toxicity has just hit the fan.

However, those in both the talk and print media, who are sanctimoniously gloating over FOX’s self-imposed misfortune, had better take a real hard look at themselves in the mirror. The strategy of serving up red meat to highly defined core audiences is practiced almost religiously by both the left and the right (not to mention purveyors of sports talk, specialty subjects and even music) – and the tolerance for talent deviation from this course by management has dwindled to almost zero. Today’s overworked and fear-driven managers have no stomach for audience complaints or ratings dips resulting from hosts saying things that do not resonate with the almighty “core.”

Smart programmers over the decades (and I’ve known some) understand that doggedly super-serving the low-hanging fruit of the core eventually yields diminishing returns. You wind up with a happier-but-shrinking audience of increasingly off-kilter zealots who eventually viciously turn on you when you stop feeding them the red meat they crave in what I call the daily dance of affirmation. It is that philosophical gray area between flat out lying or simply being wrong. What it comes down to is this inconvenient truth: programming for ratings, sponsorship support and audience approval isn’t simple.

Heaven help the progressive host who finds fault with Saint Biden or the conservative host who goes against the insidiously pervasive Trump factor. Or the sports talk show host who complains about the downside of betting. Or the music jock who actually engages in music criticism. This is the industry’s elephant in the room.

It’s time to acknowledge the beast.

Monday Memo: Baseball Bonanza, Part 2

By Holland Cooke
Consultant

In last week’s column, we outlined the playbook for selling radio’s 2023 baseball season. This week, how smart stations leverage the franchise to build Time Spent Listening.

Plan now to OWN the games

They’re also on SiriusXM, where you can decide which team’s feed you want to hear. And “The MLB is back on TuneIn, and this year TuneIn Premium is the destination for all things baseball. With a Premium plan, listeners get access to live play-by-play of every single game — with no blackouts.” Here in New England the NESN 360 app, “in partnership with the Boston Red Sox, the Boston Bruins and Major League Baseball,” $30 per month, “with a first-month promotional price of $1.”

So – post-exclusivity – what’s an AM/FM affiliate to do?

— Goal: Be KNOWN FOR having the games, by embracing the team. Waving the flag conspicuously, regardless of where fans hear it, can score you diary credit. Don’t quote me.

— During Spring Training, I’m wary of airing games Mon-Fri 6A-7P. But nights and weekends, why not? It’s conspicuous, also useful in diary markets, where ratings measure what’s NOTICED. And, hey, in March, every team is in first place.

— Can you go to Arizona or Florida? Admittedly not-inexpensive but ask your team network about Spring Training packages and arrangements. Some stations bring advertisers who commit early, hosted by the rep who sold the most.

— As Opening Day approaches, count-it-down in your on-hour ID. Then…

Avoid the banana syndrome

Use baseball to recycle audience in and out of games.

— Dumbest-thing-I-hear-most-often on baseball stations: During the game, when the network calls for a station ID, the station announces that it’s “your [name-of-team] station. Ugh. It’s like printing the word “banana” on the yellow peel.

— Your station’s on-hour ID – in any hour – is beachfront property. It’s where you sign your name, where you explain yourself to listeners you’ve trained to “check-in for a quick FOX News update, every hour, throughout your busy day.” Games invite listeners who might not otherwise cume your station, so use those 10 seconds to tell them why/when to come back for something else useful.

— “CATCH-up when you WAKE-up, with a quick morning update and your AccuWeather forecast, on your ONLY local news radio, [dial positions, call letters, city of license].” Opportune, since the game might be the last thing they near at night.

— Then in NON-game hours, use top-of-hour to wave the flag. Plug team-and-time of the next game you’ll air.

Audacy Third Quarter Net Revenue Falls 4%. The company reports Q3 net revenue of $317 million – a decline of 4% over the same period in 2021. Additionally, Audacy reports an operating loss of $151.9 million compared to operating income of $29.3 million in Q3 of 2021. The company reports a net loss of $141 million for the third quarter of 2022 compared to the net loss of $4.76 million it reported during the third quarter of 2021. Breaking down Audacy’s revenue by segment, it reports local and national spot business was $205 million, a decline of 7.2% over the same period in 2021. Digital revenue (including podcasting) was $62.7 million, an increase of 2.1% over Q3 of 2021. Network revenue was $23.7 million, up 0.9% over the third quarter of 2021. Audacy chairman, president & CEO David J. Field comments, “Our third quarter revenues declined 3.8% as advertising headwinds impacted company performance. Solid double-digit growth in streaming audio and digital marketing solutions were offset by declining radio revenues. Our radio revenues were negatively impacted by our concentration in the country’s largest markets as small to medium market radio outperformed large market radio by 8% during the quarter. We remain deeply focused on executing our action plan to navigate the storm and emerge healthy and strong. We completed the sale of $56 million in real estate to enhance our financial position with additional sales in the pipeline. We launched the next generation of our Audacy streaming platform with innovative features including segment chaptering of live spoken-word radio shows. Since launch, digital listeners are up 25% while registrations have increased 15% and we have high expectations for the impact of the new platform on our future growth. We also continue to make progress on core strategic growth drivers such as national enterprise business development and our ad tech product roadmap to open important pools of demand and accelerate future performance. Looking beyond the challenging current macro environment, Audacy has been transformed into a leading, scaled multi-platform audio content and entertainment company, better able to serve listeners and customers than ever before. We are excited by the opportunities ahead and are deeply focused on continuing to best position the company to compete for significant growth in the dynamic audio market.”

I love gold, guns, freedom and my smokin’-hot, redheaded wife. We’ll look at the issues from all angles. We’ll think outside the box, avoid groupthink, and declare our independence from the tyranny of big government. Most of all, we’ll make freedom fighting fun again!” The network is owned and operated by the husband and wife team of Rick and Tracy Ellis. Tracy Ellis says, “When Rick and I started the ‘Real Talk Radio Network’ it was always important to us to make sure our listeners were kept up to date not only on local news and politics, but throughout the state of Missouri. We have followed Austin Petersen for some time and with his home base in Jefferson City, we felt he was the perfect fit to the puzzle at ‘Real Talk.’ Many local politicians came to us directly and spoke highly of Austin and how much they enjoyed being on his former show and would love to hear him on our stations.”

WABC’s McGuirk Tribute Airs Today. The day-long remembrance of Bernie McGuirk on Red Apple Media New York news/talk WABC-AM & WLIR-FM “77 Talk Radio” began at 6:00 this morning (Wednesday, 10/12). The 65-year-old McGuirk passed away last Wednesday (10/5) from prostate cancer. For the past four and a half years, he and Sid Rosenberg co-hosted “Bernie & Sid in the Morning.” According to Red Apple Media owner John Catsimatidis, who purchased WABC two years ago, “We are airing this all-day tribute to honor our friend and colleague, who loved New York, radio, and his listeners. We’ll have the opportunity to bid farewell to a wonderful man who reached WABC radio listeners around the world every morning with his unique take on the news.” Red Apple Media/WABC radio president Chad Lopez notes, “Bernie’s observations and analysis of world and local news and politics were not only insightful – they were authentic. His brilliant mind, combined with that New York attitude, [gave] listeners what they wanted – the truth; we will miss him.” News anchor/air personality Charles McCord worked with McGuirk during their years together on “(Don) Imus in the Morning” and will appear this morning in the 9:00 hour. Among others scheduled to be part of the tribute are: New York City mayor Eric Adams; comedian/longtime “Imus” cast member Rob Bartlett; sports talk host Christopher “Mad Dog” Russo; former “Imus In The Morning” sports personality Warner Wolf; NBA play-by-play announcer Mike Breen; actor/author Chazz Palminteri; Fox News meteorologist Janice Dean; and WABC host Bill O’Reilly. Round Four of August PPMs Released. The fourth round of ratings data from Nielsen Audio’s September 2022 PPM survey has been released for Austin; Raleigh; Indianapolis; Milwaukee; Nashville; Providence; Norfolk; Jacksonville; West Palm Beach; Greensboro; Memphis; and Hartford. Nielsen Audio’s September 2022 sweep covered August 18 – September 14. TALKERS magazine managing editor Mike Kinosian presents his “Ratings Takeaways” from this group of markets. Three news/talk outlets are included in West Palm Beach’s top twenty (6+). A four-tenths improvement from August 2022 by iHeartMedia’s WZZR (1.8 – 2.2, 6+) coupled with co-owned WJNO’s half-share dip (1.8 – 1.3, 6+) results in “92.1 Real Radio” (ninth to eighth) overtaking “News Radio 1290” (#9 to #11). Also in that Florida market’s mix is Hubbard Broadcasting-owned WFTL “News Talk 850,” which drops two-tenths (1.1 – .9, #13 to #14, 6+). Although they only yield a combined 5.0 (6+), four Hartford news/talk stations crack the top twenty. Leading that group is Audacy’s WTIC-AM, although “News Talk 1080” logs a full-share deficit from August (4.6 – 3.6, 6+), slipping from eighth to ninth; its internet stream is unchanged in share and market rank (.2 and #20, respectively). Meanwhile, Red Wolf Broadcasting-owned WDRC-AM “The Talk of Connecticut” picks up two-tenths (.8 – 1.0,  #15 to #14, 6+) and iHeartMedia’s WPOP “News Radio 1410 AM & 100.9 FM,” which had been unlisted since April, resurfaces with a .2, (#20, 6+). See Mike Kinosian’s complete “Ratings Takeaways” from this group of markets (as well as the first three groups) here.

Charges Dropped Against Subject Of “Serial” Podcast. Baltimore prosecutors yesterday (Tuesday, 10/11) dropped charges against Adnan Syed in the 1999 killing of Hae Min Lee, a case that was chronicled in the first season of the podcast “Serial.” Laura Nirider, co-director of the Center on Wrongful Convictions at Northwestern Pritzker School of Law, tweeted, “After the latest round of DNA testing generated results that, like previous rounds of testing, excluded Adnan Syed, he has now been formally exonerated.” A Baltimore judge last month overturned Syed’s murder conviction and ordered him released from prison, where the 41-year-old had spent more than two decades. Circuit judge Melissa Phinn gave prosecutors 30 days in which to decide whether to retry Syed or drop the charges. Syed captured the attention of millions in 2014 when the debut season of “Serial” focused on the case and raised doubts about some of the evidence, including cellphone tower data. Syed served more than 20 years in prison for strangling the 18-year-old Lee. Her body was found weeks later buried in a Baltimore park. More than a decade later, “Serial” revealed little-known evidence and attracted millions of listeners, shattering podcast-streaming and downloading records. Prosecutors failed to tell Syed’s defense attorneys about evidence that would have allowed him to defend himself, including details that established two other people had threatened Lee’s life. In a Tuesday afternoon press conference, the state’s attorney for Baltimore, Marilyn Mosby, said that recently tested DNA completely exculpated Syed from the crime. She declined to say if any other known suspects may be implicated in the recent DNA testing, saying that the investigation is ongoing.

The Bryan Broadcasting-owned outlet began as experimental station 5XB in 1914 and was officially licensed as WTAW by the Commerce Department in 1922. Vice president/general manager Ben Downs comments, “When we followed the [Rush] Limbaugh wave into talk in 1989, it was a great day for the station. We still control the 25+ demos, which isn’t bad for a 100-year-old station – even though we don’t look a day over 70.” … Attorney/Corporation For Public Broadcasting board chair Bruce Ramer will be honored tonight (Wednesday, 10/12) with CPB’s “Lifetime Achievement Award.” CPB president/chief executive officer Patricia Harrison notes, “Bruce Ramer’s award is in recognition of his extraordinary leadership and guidance given to CPB over the nearly 14 years of his service. He led CPB’s support for innovation, interconnection, infrastructure, and access to content over many platforms. [Bruce] was committed to strengthening local, national, and international public media journalism and editorial integrity. On a meaningful level, he always advanced diversity and inclusion personally and professionally.” CPB vice chair Laura Gore Ross adds, “Bruce’s leadership has strengthened CPB and public media when we needed it most. On his watch, CPB was able to distribute $75 million in American Rescue Plan Act funding and $175 million in CARES Act stabilization funding to public media stations. He has provided wise counsel through thick and thin that’s been felt by all.”

Tourism came roaring back after pandemic restrictions were lifted in 2021, but the surge in visitors has also caused disruptions and chaos in many shore towns, as was seen in Long Branch over the weekend when thousands of partygoers showed up at Pier Village for a pop-up party, leading to a curfew and over a dozen arrests. This year, there is also concern about the impact legal marijuana sales will have on tourism and law enforcement. Scott says, “From wild pop-up parties, groups of rowdy teens taking over the boardwalks and changes in policing laws, towns are trying to avoid a repeat, and provide the best possible experience for vacationing families.”…..The RTDNA is announcing the winners of Regional Edward R. 15th Annual ‘Hold Their Feet to the Fire’ Radio Row Scheduled for September 21-22. The Federation for American Immigration Reform announces that the 15th annual Hold Their Feet to the Fire radio row broadcast in Washington will take place this year on Wednesday, September 21 and Thursday, September 22. This event brings talk hosts from across the nation to Washington to broadcast live both days debating immigration policy while interviewing members of Congress, law enforcement officials, experts, activists, administration officials, high-profile media personalities, and those who live and work along the southern border. This September marks its 15th anniversary coinciding with the most consequential midterm election of our lives. Those outcomes will determine whether Biden’s Border Crisis continues and will also set the stage for 2024. This event is about harnessing the reach and influence of talk radio to properly inform voters on the immigration issue.” This year, “Hold Their Feet to the Fire” is being staged at its new location on the rooftop terrace of FOX News overlooking the Capitol at 400 North Capitol Street in Washington. D.C. The event accommodates 75 hosts in the broadcast center and fills up earlier each year. Reservations are required and hosts should call FAIR immediately to reserve a booth.
