Suzanne Miller and New York Real Estate Saluted at Gala WABC Awards Party

Robert PearlNoted real estate industry figure and radio personality Suzanne Miller, the founder of Empire State Properties and host of “The Miller Report,” was honored last night (12/11) in a dazzling awards party featuring speakers, food, music, and dancing in the Manhattan offices and studios of WABC Radio. The event brought together New York media luminaries, and close friends of Miller for a night, in a packed room, celebrating not only her accomplishments but the resilience and vibrancy of the city she loves.

WABC Radio and Red Apple Media owner John Catsimatidis set a festive tone by introducing legendary entertainer (and multi-station NYC radio personality) Joe Piscopo. Piscopo delivered an unforgettable performance of Frank Sinatra classics, including “New York, New York,” igniting a chorus of guests singing along. “This is what makes New York the greatest city in the world!” exclaimed Catsimatidis, who shared the stage with WABC stars Rita Cosby, Sid Rosenberg, and Frank Morano, alongside his wife (and WABC co-owner), Margo Catsimatidis, and WABC/Red Apple Media president Chad Lopez.

Lopez lauded Miller’s career. “Suzanne has achieved over $5 million in sales and transactions, created 500 jobs, and played a pivotal role in rebuilding Battery Park after 9/11,” he remarked. “But if you ask Suzanne, she’ll tell you her greatest accomplishments are her two children. That humility is what makes her so special.”

Miller, visibly moved, expressed heartfelt gratitude to the audience. “A year and a half ago, I was at my kitchen table with my kids, dreaming about ‘The Miller Report,’” she shared. “Today, we’ve touched over 5.5 million people, discussing New York, real estate, and life itself. This city, these people, it’s what drives me.”

She recounted her journey as a Brooklyn-born daughter of immigrants, whose parents arrived with just $30 after surviving immense hardships during World War II. Recounting her humble beginnings in Canarsie, she gave a shout out to another Canarsie kid, radio host and Guardian Angels founder, Curtis Sliwa, also in the room. Her mother’s investment in a Brooklyn property sparked Miller’s lifelong passion for real estate. “That’s when my love for New York began,” she said. “This city is tough, but its heart is unbreakable. Never bet against New York!”

Rita Cosby highlighted Miller’s impact on the city. “Suzanne, you’ve been a cornerstone of WABC and a vital part of New York’s growth,” Cosby praised. “You embody what makes this city thrive – vision, grit, and compassion.”

Sid Rosenberg delivered his assessment of the Big Apple: “Real estate is booming here in New York, but we’ve got to vote smart. It’s time to bring back our beautiful city and state to what they should be – but we need to have the right leadership,” he said in his signature New York style.

As the evening progressed, Miller’s humor and candor shone. She thanked her team, family, and key supporters, including Gary Brody, who helped brand “The Miller Report.” She also paid tribute to Margo Catsimatidis, calling her “the First Lady of New York” for her “elegance and influence.” As for the city’s future. “We’ve got work to do,” she said passionately. “But New York isn’t just going to survive – it’s going to thrive.”

The WABC Awards Party was a testament to the enduring spirit of New York City and the power of community. In the words of Chad Lopez, “Tonight, we honor Suzanne Miller not just for what she’s done, but for what she inspires us all to be.”

Mike Gallagher and Hugh Hewitt Fill in for Dennis Prager on the High Seas.  With his Salem Radio Network (SRN) colleague Dennis Prager still sidelined after a serious back injury suffered during a fall last month, talk host Mike Gallagher boarded the Rotterdam – one of Holland America’s newest ships – to pinch hit on a Prager Listener Cruise to Aruba and other Caribbean destinations last week.  SRN’s Hugh Hewitt hosted the first half of the cruise which offered daily in-person presentations for listeners in the ship’s theater. (Ever the showman, Gallagher also entertained Prager listeners with a rendition of the “Guys and Dolls” Broadway hit “Sit Down You’re Rockin’ The Boat.”) Gallaher (pictured above during one of the events onboard) admits, “Dennis’s listeners are so loyal, I initially feared they might make Hugh and me walk the plank, but we had a fantastic time, and it was a great tribute to Dennis on the high seas.”

Pew Study:  Newsmax among Top U.S. News Brands.  Newsmax The ratings competition for eyeballs and eardrums between multi-platform news content providers has grown increasingly fierce as burgeoning interest in politics – especially during this remarkably heated 2024 election cycle – has driven huge audiences to information venues seeking the latest data and ideological affirmation. The correlation between MSNBC’s notable ratings declines after the “Morning Joe” visit to Mar-a-Lago illustrated the sensitivity of branding and audience expectations within this volatile arena.  So, what media outlets did Americans turn to for political news during the heated 2024 presidential election?  Pew Research did some digging to find out and Newsmax has earned bragging rights for being among the top U.S. news brands for Americans seeking political news. The Pew survey for September of 2024 asked close to 10,000 Americans: “What news source do you turn to most often for political news?”  The question was open ended — with Pew giving no possible responses as respondents gave their own answers.  The Pew Study found Newsmax ranked among the top news outlets and networks and tied with media giants X (formerly Twitter) and YouTube — as respondents’ go-to source for citizens seeking political news. Newsmax even ranked ahead of the Associated Press and local news, and was just one percentage point behind NBC, CBS, MSNBC, and The New York Times.  Major established news outlets FOX News, CNN, and ABC News led the pack. “Multiple studies continue to show Newsmax is a major news player, and we are continuing to rise,” Newsmax Inc. CEO Chris Ruddy tells TALKERS. “The credit belongs to our team here and our viewers who are tired of old media and want the quality journalism we’re providing.” The Pew study confirms a recent Reuters Institute study that found Newsmax was one of the top 12 U.S. news brands for Americans.  The Reuters study found 8% of Americans — about 25 million Americans — turn to Newsmax on cable TV for their news at least weekly.  Starting as a conservative website, Newsmax was launched as an entrepreneurial initiative in 1998 by then-independent journalist Ruddy and expanded to include a TV network in 2014 .  Today, Newsmax estimates it reaches more than 40 million Americans through its television channels, online websites, and social media. The company has raised over $100 million for its Preferred Share Offering in its pre-IPO plan and expects to close soon.

Kansas Association of Broadcasters Creates Customizable Trust Campaign for Kansas Stations

KABIn an age of rapid information and rising concerns about misinformation, the Kansas Association of Broadcasters (KAB) announces the launch of its statewide KAB Trust Campaign: “Rooted in Community, Committed to Truth.” This initiative highlights the critical role Kansas broadcasters play as trusted sources of news and information.  “Broadcasting is built on trust, accountability, and community connection,” KAB president Allison Mazzei tells TALKERS. “This campaign reminds Kansans of the unique value broadcasters provide – delivering accurate, timely, and trustworthy information in an era of misinformation.” To support this effort, KAB partnered with KMBC, Hearst, to produce customizable TV and radio spots, along with digital assets, available to Kansas stations at no cost. USAGM CEO condemns Russia’s conviction of RFE/RL journalist Nika Novak

RFEYesterday (11/26), a Russian court in the Siberian city of Chita sentenced Radio Free Europe/Radio Liberty (RFE/RL) journalist Nika Novak to four years in prison. “The unjust conviction of RFE/RL journalist Nika Novak continues Russia’s cruel pattern of persecuting and silencing journalists simply for reporting the truth,” said USAGM CEO Amanda Bennett. “Nika has been wrongly detained by Russia for more than 11 months on bogus charges. It’s time for her to be released without delay and allowed to return to her family.”   “We condemn the unjust conviction and sentencing of RFE/RL journalist Nika Novak in Russia,” said RFE/RL President and CEO Stephen Capus. “These politically motivated charges are intended to silence individual reporters and cause a chilling effect. We call for Nika’s immediate release to her family.”  Novak was first detained by Russia on December 25, 2023. Sources close to the investigation told RFE/RL on November 26 that Novak was found guilty of “collaboration with a foreign organization on a confidential basis.”  Since 2022, Novak has collaborated with RFE/RL as a freelance correspondent for Siberia.Realities. She has been the head of the Gifted Center in Chita since 2021. NY Attorney General James Stops SiriusXM from Trapping New York Customers in Unwanted Subscriptions

NY Atty GenNew York Attorney General Letitia James today (11/22) announced that a court found SiriusXM Radio, Inc. violated the law by forcing customers to undergo a long and burdensome process to cancel their subscriptions. AG James sued SiriusXM in 2023 after an investigation by the Office of the Attorney General (OAG) revealed that the company requires its subscribers to call or chat online with an agent to cancel a subscription and trains its agents not to take “no” for an answer. SiriusXM’s alleged illegal process deliberately draws out conversations with customers as part of a strategy to prevent them from canceling their subscriptions.  “No one should have to endure a lengthy and frustrating process to cancel a subscription, and any company that forces customers to jump through unnecessary hoops to end their subscriptions is breaking the law,” said Attorney General James. Sirius XM“This decision found SiriusXM illegally created a complicated cancellation process for its New York customers, forcing them to spend significant amounts of time speaking with agents who refused to take ‘no’ for an answer. My office sued SiriusXM to protect consumers, and as a result of our actions, they will have to simplify their cancellation process to stop taking advantage of New Yorkers.”  SiriusXM has approximately 35 million subscribers of which nearly 2 million are New Yorkers.

SiriusXM provided TALKERS with the following response:  New York started this case last year by alleging that “SiriusXM has continued to engage in repeated and persistent fraud and illegality.”  Today, we know, and the State of New York knows, that is not true.

Yesterday, the Court dismissed almost all of the charges against SiriusXM, and found that SiriusXM’s policies were neither misleading nor deceptive.  Most importantly, the Court ruled that SiriusXM had shown through “a plethora of material… that they have taken repeated steps to avoid creating such an atmosphere” of fraud or deceit.  While the Court found some technical violations of a Federal statute, it did not find that SiriusXM ever deceived anyone or committed any fraud. SiriusXM intends to appeal the Court’s ruling as to those technical violations.

Additionally, SiriusXM will abide by the recent FTC ruling when it goes into effect.

Morning JoeNielsen Media Research: Morning Joe Ratings Plummet After Co-hosts Meet with Trump. Nielsen numbers indicate that the MSNBC “Morning Joe” show ratings suffered a significant drop on Tuesday (11/19) after co-hosts Joe Scarborough and Mika Brzezinski announced that they met with President-elect Donald Trump at Mar-a-Lago. “Morning Joe” delivered one of its lowest-rated programs of 2024 with just 680,000 viewers and 76,000 in the 25-54 demo on Tuesday. Tuesday was the show’s third lowest broadcast of 2024. Compared to the show’s 2024 average, Tuesday’s broadcast plummeted 38% with viewers and 37% in the 25-54 demo. And compared to Monday’s broadcast, the show was also down double digits seeing a 12% decline with both viewers and A25-54.

Harry HurleyWPG, Atlantic City Morning Legend Harry Hurley Makes Prestigious List. The InsiderNJ.com Annual New Jersey Power List 2024 has again placed longtime WPG, Atlantic City morning host Harry Hurley as one of the Garden State’s most politically influential citizens (11/20). It is always released on the Wednesday of the New Jersey League of Municipalities Conference. Hurley placed in the #48 position on this year’s list. Power lists are nothing new for Hurley who came in at #25 on the 2024 TALKERS “Heavy Hundred” list of the 100 Most Important Radio Talk Show Hosts in America. TALKERS publisher Michael Harrison says of Hurley, “If talk radio were boxing, Harry Hurley would be its ‘pound-for-pound’ champion.”

Actor Kevin Sorbo was in town to deliver a speech and he took the time to appear on the Jeff Katz Show. Katz presented Sorbo with a Julia Katz bracelet which is made by Emily Morrissey, a local artist with special needs, who sells her work at http://www.emilysbracelets.com  and then donates the profits to a variety of charities including The Friendship Circle of Virginia which benefits from the sale of each Julia Katz bracelet. Julia Katz is the adult daughter of Jeff Katz who has faced special needs challenges since birth and has been the inspiration for the radio star’s enormous humanitarian contributions over the years to money- and consciousness-raising in the Richmond market.

Thanks to our shared position on the Newhouse School Advisory Board at Syracuse University, I learned how he is advancing his career while seeking the right job.

Chris isn’t brushing up his CV or tracking down references, he is taking a strategic action that will enhance his career and his life!

Everyday he cold calls people he would like to meet or talk to. He reaches out to executives and decision makers at all levels of corporate decision making. Yes, dozens of people are happy to meet him, talk with him and share the introduction. It’s mutual. Chris thinks the people he is calling are powerful, useful, smart, positive. They also think the same of Chris. There is no downside or risk to this adventure.

No, he doesn’t pitch them for a job. He doesn’t have to. The “pitch” is in the call, the conversation, unspoken. After the call, Chris is top of mind to another decision maker, another ally, another peer. PEER.

Licht says he has contacted about 150 people who have become new friends, new colleagues.  He might take a job with one of them, but more importantly when he does accept a new position he will have a new, sizable network of pros to help him achieve his goals

International Radio Exchange Program Offers New Perspectives on Media and Democracy

Following the 2024 election cycle, there has been a flurry of conversation and speculation over the diminishing role linear media played in deciding the outcome of high-profile national races. With both the Trump and Harris teams choosing to heavily engage with social media influencers, digital media outlets and podcasters, campaign operatives have demonstrated that they are willing to shift their political ad spending into newer forms of broadcast messaging. This has called into question just how much influence and effectiveness legacy media has over audiences in the current media market.

However, not every country shares this perception. In 2020, WRHU Radio Hofstra University in New York formed an alliance with 89.5FM Bush Radio in Cape Town, South Africa. Bush Radio is the oldest community radio station in South Africa, having long been an established voice for the Cape Town area since the early 1990s. With programming in three languages and a highly diverse staff, the station is deeply ingrained in the fabric of the Cape Town media space. The parallel goals of WRHU and Bush Radio, specifically emphasis on local journalism, community programming and educational radio training, provided a strong foundation for the stations to build this joint venture. The purpose of this partnership was to explore the power and reach of community radio in each station’s respective broadcast area. Since the inception of this relationship, both stations have enjoyed a continuous flow and exchange of ideas, goals and programming, even co-producing a weekly show called “1World Radio,” which highlights news, talk and music content featured WRHU and Bush Radio.

As part of this alliance, the stations were able to engage in a radio exchange program commencing just before the 2024 U.S. elections. With monies gained from a cultural grant, Bush Radio sent five radio journalists abroad to New York and Washington, DC to cover the national elections. The purpose of this trip was for the Bush Radio journalists to have the opportunity to see the American democratic process up close and later report their findings back to the Cape Town listening audience.

During the New York leg of their journey, I had the pleasure of offering our colleagues from WRHU’s “sister station” an up close and personal look at some of the New York’s finest broadcast institutions. The Bush Radio journalists, using WRHU as their base of operations, had the chance to visit New York Public Radio, Salem Media of New York, Long Island News Radio and fellow NCE broadcasters at WHPC and WCWP. Bush Radio members had the opportunity to interview local politicians, interface with student journalists and even participate in some radio broadcasts, including AM970’s “The Arthur Aidala Power Hour” “The One Leg Up Podcast” with Alex Garrett and WRHU’s Hofstra’s Morning Wake Up Call.

At the beginning of their visit, the Bush Radio team had a number of pre-conceived notions about the American electoral process, national media and cultural ideals. They were all aware of the large impact that American media has had on the rest of the world, with most of their impressions of the USA generally rooted in older idioms of American pop culture, specifically things they had seen on MTV, NBC, ABC and other international network programming originating from the United States. They believed the American elections were similar to the south African cycle, with campaigns lasting only for a few months and a generally receptive population to the post-election outcomes.

However, after spending some time in New York City, Washington, D.C. and Long Island conducting interviews and analyzing news reporting during their visit, their perspective was much different. The Bush Radio journalists were amazed at the drastic differences in reporting they saw across different news outlets. They observed that different stations were geared to provide favorable reporting to targeted audiences, which was something they noted didn’t happen back in South Africa. They were also surprised at how divided and polarized Americans were, summing the experience to how people would choose sides as if they were rooting for a favorite football or soccer team. Finally, they noticed that while the national media seemed to be coalescing around Harris as their preferred candidate, the polling was pointing towards a Trump victory. The stark differences between the bias of the media verses the national momentum was also surprising to them.

According to the Bush Radio journalists, they felt that linear network and community broadcasting carried a much larger influence back home than it did in the United States. They believed that this was partially because much of their domestic population does not have access to broadband internet, which meant that many still relied on terrestrial broadcasting to receive their information. However, they also observed that many people they spoke to had developed a distrust of the media. The South African journalists believed that much of this sentiment stemmed from apparent media bias, since the national reporting didn’t seem to accurately reflect the polling trends. They also pointed out that due to the wide array of media outlets and digital content providers that were available to the public, there seemed to be a dilution of credibility across all media sources, as the sheer volume of stories made it difficult for people to fact check all of the decentralized information.

However, the Bush journalists also observed that many Americans held the First Amendment in high regard. Freedom of speech and expression is a relatively young concept in post-apartheid South Africa. The journalists were amazed at the confidence and accessibility Americans presented when it came to sharing personal opinions or thoughts. This, according to the Bush Radio journalists, was not a widely accepted practice back home.

Many of the journalists were also amazed at the willingness of different groups to cross “traditional cultural lines” to vote for candidates that were from different ethnic backgrounds. They noted that back home, voters from specific racial backgrounds would generally align with candidates that were of a similar race. According to the journalists, this demonstrated that the idea of being “American” alongside the marketing of a candidate was a unique force that could work against ingrained or learned racial stereotypes and biases.

Despite the contentious nature of the elections and the high level of emotion generated by the outcome, the Bush Radio folks believed that the American democratic process was indeed intact and that their role as community radio journalists was now more important than ever. They noted that if they could be the “standard-bearers” of the news and produce reliable and credible content, it would draw greater listenership to their linear programming. According to the journalists, credibility was the most important element a radio station could have, especially as people around the world look for new ways to consume information. They acknowledged the fact that regardless of our cultural differences, they saw a similar passion for broadcasting and community service among their radio counterparts in New York, especially after interfacing with the students at WRHU. They also learned a very valuable lesson during their visit, specifically that New York pizza has the power to bring opposing groups together, as it was their observation this celebrated cuisine seemed to be served at every management meeting that required uncomfortable discussions or decision making. As one of the Bush journalists exclaimed after enjoying his first slice, “this pizza could solve all of the world’s problems.”

As a continuation of the WRHU-Bush Radio partnership, members of WRHU have been invited to travel to Cape Town in February and participate in the reporting on the results of the South African elections. Based on the feedback from the South African journalists, I am confident that this experience will be just as rewarding and exciting as it was for the Bush Radio participants.

Today is Veterans Day 2024 (11/11) – an extremely important date on the news/talk media calendar.

Election Takeaways for News/Talk Radio

MH UCFO studioThis presidential election cycle provided a number of insights, revelations, and takeaway lessons for news/talk radio.  And by using the term “news/talk radio” I mean all spoken word platforms on the AM/FM dial including commercial, public, educational, and ethnic outlets that provide news, politics, and commentary.  They are all RADIO.

1. ​Conservative talk radio is legitimate. Its detractors who claim its content and opinions only address a relatively small percentage of the American public and a dying demographic are obviously misreading the tea leaves.  Conservative talk radio is big, influential, and a long-time bellwether of American public opinion.  Conservative talk radio would do much better than it already does in terms of ratings and revenue if it were supported by its preponderance of financially crippled and intestinally paralyzed owners with the resources it needs to do what it does with maximum effectiveness.  The genre should stay the course, perhaps with renewed vigor and variety.

2. The potential for liberal talk radio has never been greater in the modern era.  Opinion radio works best when it is the resistance to “big” anything – big government, big media, big business, big religion, big tech, big pharma, and big BS. There are key differences between playing cultural offense and defense in this game.  The stage is now set for the first time since the blessed repeal of the Fairness Doctrine for a tremendous resistance and galvanizing on the left side of talk radio’s commercial offerings… now that the shoe is obviously on the other foot.  This should not be executed at the expense of conservative talk radio.  There are enough dead in the water music stations out there ready for new life.  And don’t tell me about Air America.  That’s ancient and inapplicable history.  I’m a broadcaster, not a politician. The true “battleground” of today’s dynamically polarized society should and can take place to a large and healthy extent on the AM and FM dial!  At present, YouTube is eating radio’s lunch with its energetic lineup of outstanding independent liberal talk talent (as well as conservative).

3. Public radio needs to come clean. Until public radio gets honest with itself as to what it actually represents on the true spectrum of public opinion, it will not realize growth, but rather a continuing background wallpaper role in American politics and cultural relevance. A new level of self-honesty will provide public radio with the boost it so desperately needs to move in a more pertinent direction.

4. Ethnic talk radio does not represent political monoliths. Time to wake up to that obvious fact and stop with the insulting blinders and stereotypes.

5. Joe Rogan. The radio industry should never have allowed Joe Rogan and those who will follow in his footsteps to be a non-AM/FM talk show host.   Talk radio and talk media are cousins and they currently are still genetically connected.  But they are also competitors and talk radio is fighting an uphill battle in that struggle.

CLIPPING JUSTICE: Fair Use in Media Creation

imLet’s continue our ongoing series of articles about fair use. A recent case highlights fair use considerations in audio media and podcasting, particularly concerning music and short audio clips used in intros, where some creators assume that brief snippets automatically qualify as “fair use.” Legal experts clarify that using a song clip, even if brief, doesn’t inherently meet fair use criteria. Courts have emphasized that fair use hinges not just on brevity but also on factors like purpose, nature, and market impact on the original work. Music clips, even short ones, are often seen as significant portions of the original content, carrying substantial value, making unauthorized use in podcasts or similar formats legally risky.

The concept of “transformative use” is crucial in fair use evaluations; content must add new meaning or context to the original rather than simply reformatting it. For instance, the landmark 2 Live Crew case involving their parody of Roy Orbison’s “Pretty Woman” underscored that transformative uses might still face challenges if they impact the original’s market value. This demonstrates that merely placing music in a new setting doesn’t automatically render it transformative.

To mitigate risks, media creators often incorporate shorter clips alongside commentary or critique, which tends to align more closely with fair use. Collaboration or seeking permissions can often be a more practical approach to using impactful content without risking costly legal disputes. Legal sources, including Loeb & Loeb, emphasize that while fair use is an evolving area, obtaining permissions—or using royalty-free alternatives—is often the most straightforward route for creators.

A recent example in Thiccc Boy Productions v. Swindelle illustrates these principles in action. Swindelle, a YouTube creator, used clips from Thiccc Boy Productions’ podcast, hosted by Brendan Schaub, in his reaction videos, asserting a fair use defense due to added commentary. The court ruled in Swindelle’s favor, noting his commentary was transformative and unlikely to harm the original podcast’s market. This decision aligns with trends following Warhol Foundation v. Goldsmith, which clarified that “transformative” uses must contribute clear commentary or critique to meet fair use standards rather than merely repurposing the original.

For today’s media creators, consulting legal guidance before integrating copyrighted material is crucial as copyright law adapts to new digital contexts.

BFoA Launches Annual Year-End Giving Campaign For Donations to Help Colleagues in Need.  imThe Broadcasters Foundation of America has launched its annual Year-End Giving Campaign, which seeks to raise donations from tax-deductible personal contributions to the Guardian Fund and corporate contributions to the Angel Initiative. The Broadcasters Foundation, a 501c3 charity, is the only charity devoted exclusively to helping colleagues who are in dire need of monthly or emergency financial assistance due to life-altering illness or a disaster. “We are devoted exclusively to providing aid to colleagues in broadcasting who are suffering from extreme illness, or hardship from a devastating disaster,” stated Tim McCarthy, president of the Broadcasters Foundation. “We also take care of colleagues who have retired. Grants are supported solely by contributions from individuals and companies within our industry and offer a ‘hand-up’ to our colleagues during trying times. NYPost: “iHeartMedia Slashes Hundreds of Jobs”

The New York Post is reporting that iHeartMedia has cut “hundreds” of jobs in a move executed on Monday (11/4). The Post writes, “The company headed by CEO Bob Pittman has cut less than 5% of a workforce ofim more than 10,000 employees, a source with knowledge said, amounting to hundreds of job losses as the company streamlines its business and eliminates redundancies. The story also quotes iHeartMedia spokesperson Wendy Goldberg, saying the company has focused on expanding its Gen Z audience and that its broadcast radio audience has “more listeners than it did 10 years ago. Although in a company of 10,000 people very few jobs have been affected, there have been some and we never take this step lightly no matter how few jobs it entails; every team member is important to us and has our respect and appreciation.” Read the Post story here.

Talk Radio Shines with Election Night Coverage

It was a late night of extra duty for radio talk show hosts as stations and networks across the nation garnered their human and technical resources to provide listeners with accurate news and insightful analysis of the unfolding drama of Election Night in America. In many cases, coverage was provided by panels of air staffers, contributors and special guests gathered in central studio locations and supplemented by remote audio and video call ins.  Some stations sent their talent to electoral hot spots for live remote reports. Local talk show hosts from the battleground states enjoyed extra exposure making multiple appearances as guests on other shows and platforms around the nation.  Syndication networks used the event effectively to showcase their talent lineups.  And the “special” nature of these programs created a wide variety of advertising package opportunities for radio sales departments locally and nationally. imSiriusXM Tips Off College Basketball Coverage with 74 Games on Opening Night, November 4.  SiriusXM will deliver college basketball fans an extensive schedule of live games throughout the 2023-24 college basketball season, starting with a slate of 74 women’s and men’s matchups to choose from when the season tips off this Monday (11/4).  The men’s schedule includes all 19 teams from the Associated Press Top 25 that are in action on Monday night, including the season’s first matchup of Top 25 ranked teams – #8 Baylor @ #6 Gonzaga (11:30 pm ET). TALKERS Legal Series on Fair Use (Part 6): The Law in Modern and Complex Situations

Using audio or video clips created by others often involves complex copyright considerations, especially as fair use law doesn’t automatically protect unauthorized use of media content. Cases of podcasting and talk show infringement have shown that even short clips can trigger copyright issues if they’re used in a way that substitutes the original work or diminishes its market value. It certainly can trigger flags when scanned by an algorithm.

Creators often and mistakenly believe they can legally use short clips if they’re under a specific length (often thought to be 30 seconds), but in reality, no such rule exists. Even brief clips can infringe if they are used without transforming the content or if they impact the original work’s market potential. In this vein, legal experts recommend that podcasters and media creators obtain clear permissions or licenses when using audio clips from other shows or content sources. This is especially pertinent in podcasting, where fair use is limited and can quickly lead to legal complications without the proper usage guidelines or transformative context, such as commentary or criticism.

For example, in Napster-related cases, where the focus was initially on music, courts have generally ruled against using protected content, focusing on whether the use directly impacts the market or presents a substitute for the original work. Similarly, podcasters have faced claims when broadcasting segments of popular music or clips without the required permissions, even when they used only a few seconds. To mitigate risks, media creators should consider alternatives like royalty-free audio sources or secure direct permission from copyright owners, particularly when using media that does not contribute new, critical commentary to avoid copyright liability.

Several recent copyright infringement cases have involved YouTubers and podcasters. Some cases focus on using music without obtaining necessary licenses. For example, podcasters must often secure more than just a basic ASCAP or BMI license to use music tracks, as these don’t cover all usage rights. Failing to do so has led to infringement claims against podcasters who assume that crediting a musician or using only a few seconds of a track falls under fair use, which is not always the case. Many amateur podcasters and content creators mistakenly think brief use is permissible, overlooking the need for comprehensive music licensing to avoid legal issues.

Another example is the widely reported allegations of copyright infringement in the true crime podcast sphere. Shows like “Crime Junkie” faced accusations of copying research verbatim from other sources without proper credit, highlighting the broader issue of plagiarism and copyright misuse in podcasting. Many true crime podcasts rely heavily on sources without clear attribution, leading to disputes and potential litigation due to copyright and ethical concerns. The decentralized nature of podcasting platforms makes enforcement challenging, though the legal stakes continue to rise with the medium’s growth.

These cases underscore the importance of understanding and securing permissions in podcasting and online media, especially as the medium becomes more professionalized and competitive.

WGN, Chicago Renews Contract with Host Lou Manfredini. WGN Radio today (10/28) announced a contract extension with host Lou Manfredini, the station’s do-it-yourself expert and mainstay for nearly 30 years. His call-in radio show “HouseSmarts Radio with Lou Manfredini” airs Saturdays, 6:00 am to 10:00 am, and delivers an entertaining mix of practical and useful home improvement advice. Lou Manfredini “I have been blessed to call WGN Radio home for the past three decades,” Manfredini tells TALKERS. “But in the end, it’s all about our listeners. I’m excited to continue to help them better understand how their homes work, show them they can have fun, and, of course, remind them to never hold a nail for someone else.”  The Chicagoland native will be celebrating his 30th anniversary on WGN Radio in 2025. TALKERS Legal Series on Fair Use (Part 4): The Amount and Substantiality Factor

Harrison, Esq.With the growing popularity of talk media programs utilizing segments of other shows as key elements of scrutiny and commentary in their programming (“Clip Jockey Format” as coined by Michael Harrison), it is important that media content creators be aware of the subtle and often ambiguous rules applying to the legal aspects of this practice under the heading of fair use.

This is the fourth installment of a multi-part TALKERS Legal Series on Fair Use for the Media Creator. The first installment is here. The second installment is here. The third installment is here.

The “amount and substantiality” factor in fair use focuses on how much of the copyrighted material is used and whether that portion is essential to the original work. Despite seeming obvious, this factor can be nuanced, and determining how much use is fair can be challenging because it’s not just about the quantity but also about the significance of the portion used.


Is It Difficult to Distinguish?

In many cases, it’s not always obvious what qualifies as a “small” or “insignificant” portion. Courts often consider both the quantity, and the quality of the material used:

• Quantity: This factor asks if only a small part of the work has been used. Using a shorter clip from a video or a few sentences from a book could be more justifiable as fair use. But what qualifies as “small” can vary depending on the work—10 seconds from a short film may be seen differently from 10 seconds in a longer documentary.

• Quality: Even if a creator only uses a small part of the original work, using its “heart” or most memorable part might still count as substantial. For example, a few lines from a song’s chorus, though short, could be considered significant enough to impact fair use status.

Example Cases Highlighting Amount and Substantiality

To better understand this, it’s useful to look at cases that illustrate when the amount used was deemed fair or not:

• Harper & Row v. Nation Enterprises (1985): This case involved a magazine that used a few hundred words from an unpublished memoir by President Gerald Ford. Although this was a small percentage of the memoir, the excerpt contained key insights into Ford’s decision to pardon Nixon. The court held that this use was not fair because it included the most “substantial” and critical part of the memoir, even though the total percentage of text used was minimal.

• Campbell v. Acuff-Rose Music, Inc. (1994): Here, the hip-hop group 2 Live Crew used portions of Roy Orbison’s song “Oh, Pretty Woman” to create a parody. Even though the song’s recognizable parts were used, the new work was transformative in its purpose (a parody rather than a love song). Because the group’s use was a small part relative to the song’s total content and had a new purpose, the court found it was fair use.

Many books and law school classes have been devoted to this question – so let’s focus on Application in Media and Broadcasting

In radio and broadcasting, this factor is often relevant when using clips, songs, or interview segments from other sources. Using a small clip to support commentary or criticism is more likely to be considered fair use, especially if it does not contain the “heart” of the original work:

• Commentary on a Speech: If a talk show uses a brief part of a public figure’s speech to critique it, the fair use factor may weigh in favor of the radio station if it doesn’t take the most memorable segment.

• Use of Music in Shows: Music clips used for thematic transitions or commentary must be kept brief, as lengthy or highly recognizable parts can affect fair use status. Playing just a few bars might qualify, but a chorus or instrumental hook would likely cross the line. This is less of a mine field in traditional broadcast radio as existing license agreements, such as with ASCAP or BMI, may allow for such uses anyway. However, when focusing on the internet – it’s a completely different matter as no licenses have been formally given, yet there is an incentive for the copyright holder to have their work shared. It’s not cut and dry – which is why the following takeaways should be helpful when navigating forward.

Key Takeaways for Media Creators

• Use Minimal Amounts: The less you use, the more defensible your case for fair use, especially if you avoid the most recognizable parts.

• Avoid the “Heart” of the Work: Select portions that serve your purpose without including critical or memorable parts of the original material.

• Transformative Purpose Matters: If the use adds new meaning or serves a different function (e.g., satire, critique), it’s more likely to be deemed fair, even if it includes some key elements.

Summary

Understanding how much of the work a media creator can use while staying within fair use guidelines can be tricky, as this factor requires balancing quantity and significance. Media creators should focus on minimal use that contributes meaningfully to commentary, criticism, or other transformative purposes.

POWERFUL STORY!  The New York Times: Her Job Was Talking on the Radio. Then Suddenly, Words Wouldn’t ComeAlison StweartOne day last winter, Alison Stewart, the host of “All of It” on public station WNYC, New York was alarmed to find herself speaking gibberish. Stewart’s health crisis began on February 22, a day jump-started by a 6:00 am workout with her personal trainer. She was pushing herself to get back in shape after having donated a kidney to her sister six months earlier. The workout was routine, though she barely spoke, which was unlike her.  As the morning progressed, she began to feel confusion; she couldn’t engage in a lucid conversation or write a coherent text message. She headed into SoHo, to WNYC Studios, where she hosts the daily interview show “All of It,” and settled into her office to practice reading an introduction to a segment, but her phrasing hit roadblocks instead of flowing smoothly. Baffled, she sought out Kate Hinds, the show’s director. Hinds was taken aback. “She looked very upset, her skin a little gray,” she recalled. “The disintegration was so stark and alarming. I was terrified.” She urged her to see a doctor. Stewart’s doctor listened to her garbled words over the phone and told her to go straight to the emergency room. There, she was able to execute commands like touching her nose and walking backward and forward, signaling that she probably had not suffered a stroke, but a CT scan revealed a mass on her brain. Stewart, 58, was soon talking gibberish, a dreadful and mystifying development for a woman who made her living by talking. The images accompanying the music blend into a dynamic montage of individual radio talk hosts from different sectors of the industry in the process of doing their shows (and then some). The group invited talk show hosts from around the country – local and syndicated – to contribute video clips of themselves in action on the mic. And according to sources in the band, the number of contributions “more than met our expectations.” Gunhill Road video producer (and TALKERS VP/associate publisher) Matthew B.
