Edison Research says that according to Q1 2025 data from its ongoing Share of Ear study the U.S. population 13+ spends most of its daily audio time with ad-supported audio sources (64%) compared to ad-free audio sources (36%). Fair Game, Not Free Game: Navigating the Limits of Fair Use

By Matthew B. Harrison
TALKERS, VP/Associate Publisher
Harrison Media Law, Senior Partner
Goodphone Communications, Executive Producer

imIn 2016, YouTubers Ethan and Hila Klein of H3h3 Productions were sued by Matt Hosseinzadeh for copyright infringement after they used portions of his video in their reaction content. The court ruled in their favor, emphasizing that their use was transformative, added commentary, and didn’t harm the original’s market value. This case set a precedent for content creators regarding the use of existing works in commentary and criticism within their own works in the digital era.

THE BIG QUESTION: How much can one use of someone else’s work before it becomes infringement?

For spoken-word creators, this ruling underscores the key principles of fair use: if your work critiques, comments on, or transforms the original content in a meaningful way, it’s likely protected. This is much more the focus than the exact amount of seconds being used. For example, using brief clips of an interview or viral moment to dissect cultural trends or add satire aligns with these protections. Even longer clips align, if they are balanced by original commentary that requires the used clips in order to fully understand the commentary.

However, creators must tread carefully. This permission is not universal or even the default. Overusing original material or failing to add substantive commentary risks crossing the line into infringement and the Fair Use defense may not succeed. The key takeaway? Be transformative and intentional – your voice and perspective are what make your work defensible under fair use.

imAiring in more than 40 markets from Los Angeles flagship KBLA “Talk 1580,” SmileyAudioMedia’s “Tavis Smiley” show will be offered free to urban-targeted stations for one week during next month’s Democratic National Convention (8/19-22). The SmileyAudioMedia owner/TALKERS  2023 “Freedom Of Speech” award winner will broadcast from the event’s radio row inside the site of the convention – Chicago’s United Center – and other relevant locations. Smiley tells TALKERS, “Black voters will be at the epicenter of whatever happens in Chicago, a fact made more relevant with the increasing likelihood that Kamala Harris will be the Democratic Party’s presidential nominee. If the Democratic Party hopes to achieve victory in November, it will be because Black voters saved the party and, ultimately, American democracy. To date, the 2024 election has been unpredictable and unprecedented. As the battle between the candidates enters its final stretch, the policies discussed and the decisions made will have a profound and lasting impact on Black America. It’s appropriate that ‘Tavis Smiley’ listeners will be at the center of the action as the conversation occurs.” SmileyAudioMedia syndication manager Rob Wilkins (who can be reached at rob@smileyaudiomedia.com) notes, “The 2024 election is a rapidly changing, fluid story. Tavis will serve as the audience’s eyes and ears in Chicago, keeping them on top of stories as they develop during the most important political party convention of the 21st century.” Two decades ago, Smiley’s book The Covenant with Black America addressed critical issues facing African Americans. Scheduled to be released five days after the DNC concludes (8/27) is Smiley’s updated #1 New York Times bestselling The Covenant with Black America: 20 Years Later. It will provide observations and commentary on cultural, societal, and political implications of this year’s DNC with some of Black America’s most relevant thought leaders. John Catsimatidis Named Recipient of 2024 TALKERS Freedom of Speech Award

im

Self-made billionaire businessman, broadcasting entrepreneur, radio talk show host and best-selling author John Catsimatidis (pictured above speaking at last year’s TALKERS 2023) has been selected by the TALKERS editorial board as the 2024 recipient of the highly prestigious Gene Burns Memorial Award for Freedom of Speech. The honor, also commonly referred to as the “TALKERS Freedom of Speech Award,” is presented each year to a talk media practitioner whose work sets an example for the exercise and preservation of the First Amendment. In addition to Catsimatidis’ founding and/or ownership of major enterprises in the fields of grocery chains and the energy industry, he is a long-running radio talk show host who began changing the course of the medium’s history by purchasing heritage radio station WABC, New York in 2019.  Since then, the Greek immigrant born on the island of Nistros in 1948 and who came to the United States with his parents when he was six months old, has made significant progress in repositioning and reinvigorating the legendary talk and music station to its role as a major cultural and political influencer in modern media. This has been accomplished by boldly bringing diverse, high-profile voices to the station’s talent lineup, focusing heavily on local news and public policy issues, eliminating paid weekend programming, adding a dash of music and pop culture to the mix, concentrating the station’s schedule on live shows in real time and investing in community-oriented events. Catsimatidis’ Red Apple Media Group has subsequently expanded the station’s national footprint by acquiring WLIR-FM, Long Island and launching its own syndication arm, Red Apple Audio Networks. TALKERS publisher Michael Harrison, upon announcing the selection, stated, “John Catsimatidis is a true New York City legend and former mayoral candidate who has proven to be one of the most positive forces the radio industry has seen in decades. He embodies the spirit of what this award is all about. He joins a remarkable list of broadcasters from all ends of the political spectrum – left, right, middle, and apolitical – who’ve received this honor going back every year to the origins of TALKERS in the late 1980s.” The award will be presented at TALKERS 2024: Radio and Beyond at Hofstra University on Long Island Friday, June 7.

Many of them lost their life’s savings by way of Freeman’s bitcoin moneyim laundering scheme. Ian, our co-founder, received eight years in prison, followed by two on probation and a $40,000 fine. Restitution and forfeiture are as yet to be determined but will likely be six figures. TALKERS 2023 VIDEO: KBLA Talk 1580 Founder Tavis Smiley Honored with Freedom of Speech Award

Prolific author and veteran talk media purveyor of current events with a focus on African American perspectives, Tavis Smiley, was honored by the TALKERS editorial board at the TALKERS 2023 conference as the 2023 recipient of the highly prestigious Gene Burns Memorial Award for Freedom of Speech. (The presentation was sponsored by The Todd Starnes Show) The award is presented each year to a talk media practitioner whose work sets an example for the exercise and preservation of the First Amendment. Smiley, who has hosted shows on a diverse array of platforms such as BETCNNABCPBS, KABCim Radio, and KGFJ Radio among others, joins such former recipients of the award as Rush LimbaughSean HannityBill O’ ReillyMark LevinMichael SavageGlenn BeckBob GrantThom HartmannAlan ColmesJoe MadisonKaren HunterAl FrankenBrian LambNorm PattizIan Freeman and others dating back to the origins of TALKERS in the late 1980s. Some two years ago, Smiley’s media company acquired an AM radio station in Los Angeles, the former hip hop legend KDAY, and transformed it into a new station and format – KBLA Talk 1580 – where he’s assembled an outstanding on-air staff, including himself, with the impassionate mission of, as he puts it, “unapologetically serving people of color and who are politically progressive.” In making the announcement of this year’s recipient, TALKERS founder Michael Harrison states, “This is our longest-running and most-important award. Mr. Smiley has risen to the enormous talk radio challenge of providing underserved African Americans and progressives with a major commercial platform in the nation’s second largest market with a worldwide reach. In today’s political environment and struggling AM radio industry, it doesn’t get any more ‘First Amendment’ than that.” Tavis Smiley was presented the award by Harrison at TALKERS 2023 on Friday, June 2 at Hofstra University on Long Island.
