Premiere Networks-syndicated personality Clay Travis, co-host of “The Clay Travis and Buck Sexton Show,” broadcast live from Israel this week (12/9-12) in partnership with the International Fellowship of Christians and Jews (IFCJ), the leading non-profit organization building bridges between Christians and Jews while providing humanitarian care and lifesaving aid. In addition to co-hosting the radio show live from JNS – Jewish News Syndicate, Travis toured the region with the IFCJ, learning about the country’s rich history and the challenges faced in the current climate. He shared his first-hand accounts with millions of listeners this week as he traveled throughout the country, including Tel Aviv and Jerusalem. In the North, Travis toured the town of Metula near the border with Lebanon that endured attacks from Hezbollah. He also met with a farmer who is struggling to maintain his crops in the face of constant rocket fire and who lost his son and several workers in an attack on October 31, 2024. In the South, Travis visited the Nir Oz Kibbutz near the border with Gaza that was horrifically attacked by Hamas on October 7. He also visited the Nova Festival site and toured a special facility that is helping traumatized families and children. Additionally, Travis met with Amir Ohana, Speaker of the Israeli Knesset, who joined the program mid-week. He also interviewed Idit Ohel, mother of an Israeli hostage taken at the Nova Festival and met with other families of hostages at the weekly Saturday night rally in Hostage Square in Tel Aviv.  Plus, Travis toured the Tel HaShomer hospital where he met with injured IDF soldiers, and visited the Palmachim IAF Base and learned about the “Adopt a Battalion” program supported by IFCJ.  “Given the importance of the American-Israel relationship, I thought it was important to see with my own eyes the challenges and successes of Israel in the wake of October 7th and bring those perceptions to our audience,” Travis tells TALKERS. “Our team did a phenomenal job, and I couldn’t be happier with what we delivered to our audience this week.”

Just Dropped: Musical Anthem Celebrating Talk Radio

Gunhill Road, the perennial pop music ensemble that has attracted hundreds of thousands of worldwide followers with its growing repertoire of issue-oriented songs and music videos, has released an anthem celebrating talk radio. “Don’t Stop Talking” is an uplifting and infectiously catchy tune about the vital role talk radio plays in supporting American freedom of speech and the First Amendment.  Non-partisan lyrics ring out: “As long as you’ve got a voice, don’t ever stop!” and “As long as you’ve got the truth, don’t ever stop!”  The original composition co-written by band members Steve Goldrich, Paul Reisch, Brian Koonin, and Michael Harrison encourages dedicated talk radio practitioners to keep up the good work and valuable service they provide the nation. The images accompanying the music include a dynamic montage of individual radio talk hosts in the process of doing their shows. Matthew B. Harrison, who produced the video visual components states, “Gunhill Road has achieved enormous internet recognition around the nation and world – much of it fueled by the attention and exposure its unique songs and videos have received on talk radio.  This amazing piece is the group’s way of giving back.” To view the video in its entirety, please click talkradioforever.com. SABO SEZ: They Fired the Sax Player!

By Walter Sabo
A.K.A. Walter M Sterling, Host
Sterling Every Damn Night, WPHT, Philadelphia
Sterling On Sunday, TMN

Walter M. SterlingA grim day. They fired the whole band. You know who “they” are! Bloated management. The future of radio… ruined!

Year: 1936. Bandleaders took WNEW, New York, to court claiming that it was illegal to play recorded music on the air. Recorded music, conductors believed, stole performance rights fees from musicians. Consequently, Radio stations hired live bands to play music and networks offered live bands to affiliates until the court made a decision on the complaint.

Ultimately, the courts said that as long as a radio station owned the record, they could play it on the air.

Local bands were fired, network bands were fired. The radio industry embraced recorded music when it realized that WNEW’s

DJ Music show, “The Make-Believe Ballroom” was pulling a 25 audience share.

Airing recorded music was legal and moral. But many talented, capable, often union musicians lost their jobs. The radio industry changed.  That change resulted in the viability of modern radio.  Recorded music birthed the business of top 40.  Kids in an Akron record shop discovered “race” music in the back of the store and bought it with passion and speed compelling the retailer to reveal the phenomenon to local DJ Alan Freed. Freed put the songs on the air for a few hours a week… then he labelled the music rock ‘n’ roll.

Rock might never have defined our culture if music selection had been left up to the in-studio live bands. And a one and a two.

But a lot of musicians were fired in 1936.

This month, tragically at the holidays, many of our colleagues have lost their jobs. Time to challenge the aging legacies and rock.

The stage awaits.

VANITY FAIR: Rogan Knocked Out of Top Podcast Spot… at Least for the Moment

According to a piece by writer Kase Wickman published yesterday (12/10) in Vanity Fair, Kylie Kelce‘s new podcast, “Not Gonna Lie,” has unseated Joe Rogan‘s “The Joe Rogan Experience” from its lofty position at the top of the most-listened charts on both Apple and Spotify.”  KelceKylie Kelce, wife of former Philadelpia Eagles star Jason Kelce, sister-in-law of Kansas City Chiefs star (and Taylor Swift boyfriend) Travis Kelce, mother of three (with a fourth on the way), and Dunkin’ Donuts enthusiast, can add another descriptor to that incomplete list: No. 1 podcast host.  Wickman writes, “I suspect Rogan will be back in first place soon, but for now, this ranking reinforces the Kelce family’s cultural dominance. (‘If everyone’s going to be talking about me and my family, you might as well hear it from me,’ she says in the show trailer.)”  Kelce’s husband Jason and brother-in-law Travis host the popular “New Heights” podcast. The inaugural episode of “Not Gonna Lie,” featuring “It’s Always Sunny In Philadelphia” star Kaitlin Olson as a guest, was published on December 5, with new episodes planned to drop each Thursday. MONDAY MEMO: “Dear Santa…”

By Holland Cooke
Consultant

imYour topic is often plucked from the on-hour newscast, asking callers’ take on what you reckon to be top-of-mind and relevant to listeners you target.

And as I have recommended here previously, it’s always useful to give ‘em a second reason to call. Hosts I coach pose a “Bonus Question,” generally something less controversial, softer, and (if you dare) fun.

im
Examples, evergreens that have lit-up the lines for hosts I coach:

• Dating co-workers” (Every workplace has one poorly-kept secret.)

• Your biggest gripe about where you work?” (“No names!”)

• What is the one thing about your spouse you would change?”

• Talking your way out of traffic tickets”

• Your least favorite song?” (An alert producer can quickly search YouTube and play a portion.)

Now – as it’s beginning to look a LOT like Christmas – many shoppers are short on ideas (and do-re-mi). So, consider asking for cool stocking stuffer suggestions. And don’t be surprised when callers answer your Bonus Question first (or don’t even weigh-in on topic du jour).

Phlash Phelps

Mural in a Phlash! During these dark, cold days of disappearing promotional budgets and AI voice tracking, how many radio personalities get their likeness painted in a mural on the side of a building?  Well, that warm honor came in one of the coldest places east of the Mississippi River to SiriusXM “’60s Gold” channel morning personality Phlash Phelps in Bradford, PA.  Pictured above: local artists and phans, Greg Souchick (l) and Rick Minard (r) expressed their appreciation for the popular music host with a huge mural on the side of a building in downtown Bradford at 181 Main Street.  Phelps was overwhelmed by the rendering and said he’s headed up to north central Pennsylvania to see it himself.  We’re not sure if any other radio talent has ever had such a tribute.  Phelps said, “I’ve had a racehorse named after me and a flag flown over the U.S. Capitol, but I’m truly stunned by this incredible mural.  My phans are phantastic!”  Part of Phelps’ schtick is he spells all Fs with PH.  He is known for his fast-talking, retro style of broadcasting and for making American geography a focal point of his show. TALKERS publisher Michael Harrison states, “Phelps is a remarkably creative disc jockey who uses the element of ‘talk’ in a most entertaining and productive way by tying local towns, villages and communities around America into his show and saluting each with special attention to detail. He is my seven-year-old grandson and geography buff, Oliver Harrison‘s favorite radio star. Don’t think I don’t take notice of such things.” Phelps is heard nationally on SXM’s channel 73 M-F 6:00 am – 12:00 noon ET.

Local “Ink-stained Wretch” is This Week’s Guest on Harrison Podcast

GMD and MHLegendary journalist and all-around local media hero in Western Massachusetts, G. Michael Dobbs, is this week’s guest on the award-winning PodcastOne series, “The Michael Harrison Interview.”  Harrison states, “Western Mass is a special place I’ve called home for the past 40 years. Although I have had several simultaneous homes in different parts of the country during this stretch of time, the Springfield, Massachusetts area has played a very important role in my life.  And in this beautiful, ‘salt of the earth’ segment of America, my guest is well-known to just about all its civically, socially and politically active citizens. His half-century career has been a testimony to the power and importance of local media… which, as we all know, is rapidly becoming an endangered species.”  After decades of service, the recently retired executive editor of Reminder Publishing, continues his multi-faceted career in mass communications. Harrison comments, “I’m not sure he understands the meaning of the word retirement.” In his no-frills-down-to-the-basics career, Dobbs has worked as a newspaper reporter and editor, freelance writer, radio talk show host, college instructor and was the editor of two nationally distributed magazines about animation. He has written seven books to date and continues to write as well as appear as a host for Focus Springfield cable television. Harrison adds, “He has covered hundreds of school board and city council meetings; conducted thousands of interviews with local leaders; knows just about everything involved in how local government operates; and is an expert on cigars, brandy, old films, cartoons, comics, and even strippers.  He’s an amazing guy and a quintessential example of the tremendous importance of local, grassroots journalism in sustaining and preserving American freedom and democracy.”  The conversation with Dobbs started out with Harrison appearing as a guest on the media practitioner’s local podcast titled, “The Ink-stained Wretch with G. Michael Dobbs.” But, according to Harrison, “The conversation went deep into some very meaty material, so I decided to dip into it and extract some content for my own podcast.” To listen to the podcast in its entirety, please click here.

Canada’s Rogers Sports & Media Lays Off Dozens of Radio and Podcast Employees. RSMAccording to an article by reporter Manuela Vega in the Toronto Star (11/19), Canadian broadcasting giant Rogers Sports & Media – reflecting major cutbacks taking place in the U.S. radio industry – has laid off more than two dozen employees in the company’s radio and podcasting divisions, citing declining revenue and challenges in advertising.  “With the radio industry continuing to feel the pressure of an uncertain advertising market, we made some difficult but necessary changes in our audio business impacting roles in several markets,” a Rogers Sports & Media spokesperson told the Star in a statement last night. The company said the job losses included a “handful” of journalists, as well as some managerial and administrative positions, but noted there would be no closures or terminations of stations, programming or podcasts. “We recognize and thank the team members who are leaving us for their dedication to our listeners and advertisers,” the statement read.  To read the complete article, please click here.

New Cumulus Media / Westwood One AudioActive Blog Post: Edison Research’s Q3 2024 “Share of Ear” Reveals AM/FM Radio is the Dominant Ad-Supported Audio Platform Across All Demos

imFor the last 10 years, Edison Research’s quarterly “Share of Ear” study has been a highly respected examination of time spent with audio in America. Edison surveys 4,000 Americans annually to measure daily reach and time spent with all forms of audio. Each report is based on a four-quarter rolling average. The most recent Q3 2024 survey is comprised of Q4 2023, Q1 2024, Q2 2024, and Q3 2024. This week’s Cumulus Media | Westwood One Audio Active Group® blog is an analysis of the just released Q3 2024 data and focuses on what advertisers care most about – ad-supported audio.

Among major demographics, AM/FM radio is the dominant ad-supported audio platform. Podcasts have significant shares among younger age groups.

Among African Americans, AM/FM radio is particularly strong. Podcast shares are not as strong as the general market.

Among Hispanics, podcast shares are stunningly strong. Among 18-34 Hispanics, podcasts are now the number one ad-supported audio platform.

In the car, AM/FM is the “queen of the road” with an 86% share. Even among 18-34s, AM/FM radio has an 82% share of ad-supported audio.

13% of all AM/FM radio listening occurs via streaming, steady over the last three years. On the smart speaker, AM/FM radio dominates with a 50% share of ad-supported listening.

Sadly for advertisers, most of Spotify’s audience is unavailable to place advertising. While Spotify’s ad-free subscription audience soars, its ad-supported shares stagnate at a two share.

Streaming music audience growth comes at the expense of owned music rather than AM/FM radio.

International Radio Exchange Program Offers New Perspectives on Media and Democracy

Following the 2024 election cycle, there has been a flurry of conversation and speculation over the diminishing role linear media played in deciding the outcome of high-profile national races. With both the Trump and Harris teams choosing to heavily engage with social media influencers, digital media outlets and podcasters, campaign operatives have demonstrated that they are willing to shift their political ad spending into newer forms of broadcast messaging. This has called into question just how much influence and effectiveness legacy media has over audiences in the current media market.

However, not every country shares this perception. In 2020, WRHU Radio Hofstra University in New York formed an alliance with 89.5FM Bush Radio in Cape Town, South Africa. Bush Radio is the oldest community radio station in South Africa, having long been an established voice for the Cape Town area since the early 1990s. With programming in three languages and a highly diverse staff, the station is deeply ingrained in the fabric of the Cape Town media space. The parallel goals of WRHU and Bush Radio, specifically emphasis on local journalism, community programming and educational radio training, provided a strong foundation for the stations to build this joint venture. The purpose of this partnership was to explore the power and reach of community radio in each station’s respective broadcast area. Since the inception of this relationship, both stations have enjoyed a continuous flow and exchange of ideas, goals and programming, even co-producing a weekly show called “1World Radio,” which highlights news, talk and music content featured WRHU and Bush Radio.

As part of this alliance, the stations were able to engage in a radio exchange program commencing just before the 2024 U.S. elections. With monies gained from a cultural grant, Bush Radio sent five radio journalists abroad to New York and Washington, DC to cover the national elections. The purpose of this trip was for the Bush Radio journalists to have the opportunity to see the American democratic process up close and later report their findings back to the Cape Town listening audience.

During the New York leg of their journey, I had the pleasure of offering our colleagues from WRHU’s “sister station” an up close and personal look at some of the New York’s finest broadcast institutions. The Bush Radio journalists, using WRHU as their base of operations, had the chance to visit New York Public Radio, Salem Media of New York, Long Island News Radio and fellow NCE broadcasters at WHPC and WCWP. Bush Radio members had the opportunity to interview local politicians, interface with student journalists and even participate in some radio broadcasts, including AM970’s “The Arthur Aidala Power Hour” “The One Leg Up Podcast” with Alex Garrett and WRHU’s Hofstra’s Morning Wake Up Call.

At the beginning of their visit, the Bush Radio team had a number of pre-conceived notions about the American electoral process, national media and cultural ideals. They were all aware of the large impact that American media has had on the rest of the world, with most of their impressions of the USA generally rooted in older idioms of American pop culture, specifically things they had seen on MTV, NBC, ABC and other international network programming originating from the United States. They believed the American elections were similar to the south African cycle, with campaigns lasting only for a few months and a generally receptive population to the post-election outcomes.

However, after spending some time in New York City, Washington, D.C. and Long Island conducting interviews and analyzing news reporting during their visit, their perspective was much different. The Bush Radio journalists were amazed at the drastic differences in reporting they saw across different news outlets. They observed that different stations were geared to provide favorable reporting to targeted audiences, which was something they noted didn’t happen back in South Africa. They were also surprised at how divided and polarized Americans were, summing the experience to how people would choose sides as if they were rooting for a favorite football or soccer team. Finally, they noticed that while the national media seemed to be coalescing around Harris as their preferred candidate, the polling was pointing towards a Trump victory. The stark differences between the bias of the media verses the national momentum was also surprising to them.

According to the Bush Radio journalists, they felt that linear network and community broadcasting carried a much larger influence back home than it did in the United States. They believed that this was partially because much of their domestic population does not have access to broadband internet, which meant that many still relied on terrestrial broadcasting to receive their information. However, they also observed that many people they spoke to had developed a distrust of the media. The South African journalists believed that much of this sentiment stemmed from apparent media bias, since the national reporting didn’t seem to accurately reflect the polling trends. They also pointed out that due to the wide array of media outlets and digital content providers that were available to the public, there seemed to be a dilution of credibility across all media sources, as the sheer volume of stories made it difficult for people to fact check all of the decentralized information.

However, the Bush journalists also observed that many Americans held the First Amendment in high regard. Freedom of speech and expression is a relatively young concept in post-apartheid South Africa. The journalists were amazed at the confidence and accessibility Americans presented when it came to sharing personal opinions or thoughts. This, according to the Bush Radio journalists, was not a widely accepted practice back home.

Many of the journalists were also amazed at the willingness of different groups to cross “traditional cultural lines” to vote for candidates that were from different ethnic backgrounds. They noted that back home, voters from specific racial backgrounds would generally align with candidates that were of a similar race. According to the journalists, this demonstrated that the idea of being “American” alongside the marketing of a candidate was a unique force that could work against ingrained or learned racial stereotypes and biases.

Despite the contentious nature of the elections and the high level of emotion generated by the outcome, the Bush Radio folks believed that the American democratic process was indeed intact and that their role as community radio journalists was now more important than ever. They noted that if they could be the “standard-bearers” of the news and produce reliable and credible content, it would draw greater listenership to their linear programming. According to the journalists, credibility was the most important element a radio station could have, especially as people around the world look for new ways to consume information. They acknowledged the fact that regardless of our cultural differences, they saw a similar passion for broadcasting and community service among their radio counterparts in New York, especially after interfacing with the students at WRHU. They also learned a very valuable lesson during their visit, specifically that New York pizza has the power to bring opposing groups together, as it was their observation this celebrated cuisine seemed to be served at every management meeting that required uncomfortable discussions or decision making. As one of the Bush journalists exclaimed after enjoying his first slice, “this pizza could solve all of the world’s problems.”

As a continuation of the WRHU-Bush Radio partnership, members of WRHU have been invited to travel to Cape Town in February and participate in the reporting on the results of the South African elections. Based on the feedback from the South African journalists, I am confident that this experience will be just as rewarding and exciting as it was for the Bush Radio participants.

1World Radio airs every Tuesday between 4:00 pm and 5:00 pm on WRHU, Radio Hofstra University.

EDISON RESEARCH: Trump Reached More Listeners Than Harris in “Podcast Election”

Exposure in election

It seems in every election cycle a new communications vehicle emerges as a pathway to gaining voter engagement. Many media observers are deeming the 2024 presidential campaign as the “Podcast Election” as both candidates appeared on high-profile shows. Edison Podcast Metrics™, a respected service that measures all shows across all platforms, presents a strong indication of the reach achieved by each campaign from their appearances. Per Podchaser – from the time Vice President Kamala Harris entered the race in July until Election Day, she made an appearance on eight shows while former President (and now President-elect) Donald Trump appeared on 20. According to Edison’s report, “While we don’t have access to the number of listeners to the specific episodes on which they appeared, and surely these episodes garnered far higher listening than the average level, we do have the estimates for the average audiences for these shows. And clearly Mr. Trump spoke to a far greater number of listeners than Ms. Harris did. Combining the average reach of each show they appeared on and then de-duplicating the results to account for listeners to more than one, the podcasts Trump appeared on reach approximately 23.5 million Americans 18+ in an average week, while the podcasts Harris appeared on reach only 6.4 million Americans 18+ in an average week. Mr. Trump’s total is of course supercharged by his appearance on what is by far the largest podcast in America, ‘The Joe Rogan Experience.’  But it’s worth noting that even if one removes Rogan from Trump’s calculation, Mr. Trump’s other appearances still would have far outstripped Ms. Harris’s. The weekly reach of many of America’s biggest podcasts outstrips that of many cable tv networks and individual television shows. It is fair to expect that this rapidly growing channel will continue to be used in any national conversations or media strategies.”

MONDAY MEMO: Optimize Your Brain

By Holland Cooke
Consultant

imDo you wish you could get in just one more hour of focused work… but your brain won’t cooperate? You’re not alone.

21st century productivity – especially for those of us in talk media where the action never stops – demands that we work against the way we’re wired. “For the brain to produce work of quality,” physician and neuroscience researcher Dr. Mithu Storoni says, “it needs to work in its own way.”

She observes how we’re expected to solve problems as though we’re feeding an industrial-era conveyor belt. But ideas can’t be manufactured in assembly-line fashion. Her solution? Rather than imposing the rhythms of work on our brains, we should impose the rhythm of our brains on our work.

im

Simple tips from her book, Hyperefficient: Optimize Your Brain to Transform the Way You Work:

Keep shifting gears. Our brains function like a car’s engine, different gears for different mental challenges. We’re better-off doing short bursts of intense work followed by longer periods of light work.

• Take a walk. Have you noticed that you have some of your best ideas when you do? Sitting upright in an office chair staring at a computer doesn’t let the mind wander.

Coffee is a friend. Storoni finds “no evidence that caffeine ingestion upon waking is somehow responsible for an afternoon ‘crash’ — or that delaying consumption would somehow prevent this if it did occur.”

Tech can be a foe. Screens are making us jittery. The quantity of information they deliver can hinder the quality of our ideas. Did you ever read an email… see red… then fire-off an ill-advised reply? And social media “has this power to distort space and time,” causing us to feel “that something we are seeing is happening now and near to us. The problem is if this event is taking place halfway around the world, you cannot do anything to make the situation better.”

Practice paying attention. “It takes some effort to focus. If I were to say, ‘Focus on that spot on the blank wall’, you’d need to work at it,” Storoni says. “Now information is cheap and attention is expensive, so everything is competing to grab our attention.”

Never ignore mental fatigue. If you do more than four hours of “mental heavy lifting” every day, Storoni says the mind can’t recover even after a night’s rest, and fatigue drags into the next day.

Election Takeaways for News/Talk Radio

MH UCFO studioThis presidential election cycle provided a number of insights, revelations, and takeaway lessons for news/talk radio.  And by using the term “news/talk radio” I mean all spoken word platforms on the AM/FM dial including commercial, public, educational, and ethnic outlets that provide news, politics, and commentary.  They are all RADIO.

1. Conservative talk radio is legitimate. Its detractors who claim its content and opinions only address a relatively small percentage of the American public and a dying demographic are obviously misreading the tea leaves.  Conservative talk radio is big, influential, and a long-time bellwether of American public opinion.  Conservative talk radio would do much better than it already does in terms of ratings and revenue if it were supported by its preponderance of financially crippled and intestinally paralyzed owners with the resources it needs to do what it does with maximum effectiveness.  The genre should stay the course, perhaps with renewed vigor and variety.

2. The potential for liberal talk radio has never been greater in the modern era.  Opinion radio works best when it is the resistance to “big” anything – big government, big media, big business, big religion, big tech, big pharma, and big BS. There are key differences between playing cultural offense and defense in this game.  The stage is now set for the first time since the blessed repeal of the Fairness Doctrine for a tremendous resistance and galvanizing on the left side of talk radio’s commercial offerings… now that the shoe is obviously on the other foot.  This should not be executed at the expense of conservative talk radio.  There are enough dead in the water music stations out there ready for new life.  And don’t tell me about Air America.  That’s ancient and inapplicable history.  I’m a broadcaster, not a politician. The true “battleground” of today’s dynamically polarized society should and can take place to a large and healthy extent on the AM and FM dial!  At present, YouTube is eating radio’s lunch with its energetic lineup of outstanding independent liberal talk talent (as well as conservative).

3. Public radio needs to come clean. Until public radio gets honest with itself as to what it actually represents on the true spectrum of public opinion, it will not realize growth, but rather a continuing background wallpaper role in American politics and cultural relevance. A new level of self-honesty will provide public radio with the boost it so desperately needs to move in a more pertinent direction.

4. Ethnic talk radio does not represent political monoliths. Time to wake up to that obvious fact and stop with the insulting blinders and stereotypes.

5. Joe Rogan. The radio industry should never have allowed Joe Rogan and those who will follow in his footsteps to be a non-AM/FM talk show host.   Talk radio and talk media are cousins and they currently are still genetically connected.  But they are also competitors and talk radio is fighting an uphill battle in that struggle.

CLIPPING JUSTICE: Fair Use in Media Creation

By Matthew B. Harrison
TALKERS, VP/Associate Publisher
Harrison Media Law, Senior Partner
Goodphone Communications, Executive Producer

imLet’s continue our ongoing series of articles about fair use. A recent case highlights fair use considerations in audio media and podcasting, particularly concerning music and short audio clips used in intros, where some creators assume that brief snippets automatically qualify as “fair use.” Legal experts clarify that using a song clip, even if brief, doesn’t inherently meet fair use criteria. Courts have emphasized that fair use hinges not just on brevity but also on factors like purpose, nature, and market impact on the original work. Music clips, even short ones, are often seen as significant portions of the original content, carrying substantial value, making unauthorized use in podcasts or similar formats legally risky.

The concept of “transformative use” is crucial in fair use evaluations; content must add new meaning or context to the original rather than simply reformatting it. For instance, the landmark 2 Live Crew case involving their parody of Roy Orbison’s “Pretty Woman” underscored that transformative uses might still face challenges if they impact the original’s market value. This demonstrates that merely placing music in a new setting doesn’t automatically render it transformative.

To mitigate risks, media creators often incorporate shorter clips alongside commentary or critique, which tends to align more closely with fair use. Collaboration or seeking permissions can often be a more practical approach to using impactful content without risking costly legal disputes. Legal sources, including Loeb & Loeb, emphasize that while fair use is an evolving area, obtaining permissions—or using royalty-free alternatives—is often the most straightforward route for creators.

A recent example in Thiccc Boy Productions v. Swindelle illustrates these principles in action. Swindelle, a YouTube creator, used clips from Thiccc Boy Productions’ podcast, hosted by Brendan Schaub, in his reaction videos, asserting a fair use defense due to added commentary. The court ruled in Swindelle’s favor, noting his commentary was transformative and unlikely to harm the original podcast’s market. This decision aligns with trends following Warhol Foundation v. Goldsmith, which clarified that “transformative” uses must contribute clear commentary or critique to meet fair use standards rather than merely repurposing the original.

For today’s media creators, consulting legal guidance before integrating copyrighted material is crucial as copyright law adapts to new digital contexts.
