Newsmax CEO Warns Christian Leaders About Media Consolidation
Last Friday (7/17), Newsmax CEO Christopher Ruddy addressed the attendees at The FAMiLY Leader’s Family Leadership Summit in Des Moines. Among the topics Ruddy spoke about included the FCC’s move to abandon the 39% ownership cap for television stations. Ruddy warned that FCC chairman Brendan Carr’s plan “is 
dangerous and would allow two or three corporations to dominate local television news, reducing competition, independent journalism, and threatening religious broadcasters.” He noted that conservative organizations including CPAC, the National Religious Broadcasters, and the Zionist Organization of America oppose lifting these ownership limits. Ruddy also took the opportunity to address how broadcasters view the American people, saying, “Polling consistently shows Americans are far more center-right than portrayed by the legacy media. I urge you to summarily suspend the NYC Taxi and Limousine Commission’s partnership with Curb… and demand that Curb cease its collaboration with Newsmax as a condition of licensure given the platform’s history of misinformation and disingenuous reporting.” Newsmax says, “This is a pure act of censorship targeting a news organization reaching over 50 million Americans regularly. Newsmax plays it straight and that drives the far left crazy.”

For years his radio program was distributed nationally by Radio America and then by Premiere Networks. At the time of his death, Reagan was serving as a columnist for Newsmax. CNN, FOX News Media, NBC News, and Newsmax are declining to sign the agreement. A joint statement from ABC News, CBS News, CNN, FOX News Media, and NBC News says, “Today, we join virtually every other news organization in declining to agree to the Pentagon’s new requirements, which would restrict journalists’ ability to keep the nation and the world informed of important national security issues. The policy is without precedent and threatens core journalistic protections. We will continue to cover the U.S. military as each of our organizations has done for many decades, upholding the principles of a free and independent press.” Newsmax adds, “We are working in conjunction with other media outlets to resolve the situation. We believe the requirements are unnecessary and onerous and hope that the Pentagon will review the matter further.”

I’m barely on anymore. I know my father was banned.” However, TALKERS has learned that Donald Trump Jr. appeared on FOX News Channel four times recently – on August 13 and September 3, 11, and 12. “FOX’s approach has left conservatives silenced while Democrats and establishment figures get free rein.” The president recently complained about FNC in a post on Truth Social in which he singled out White House correspondent Peter Doocy for talking to Arizona Senator Mark Kelly about his healthcare agenda. He wrote, “Why is Fox News and Peter Doocy putting on Democrat Senator Mark Kelly to talk about, totally unabated or challenged, Healthcare?” SiriusXM’s Megyn Kelly recently complained about FOX News Channel’s coverage of Charlie Kirk’s slaying, saying, “It’s really bothering me how FOX News is talking about Charlie, like he was theirs — he wasn’t. It’s a lie. Just stop.”
“The most common type [of shotgun pleading] – by a long shot – is a complaint containing multiple counts where each count adopts the allegations of all preceding counts, causing each successive count to carry all that came before and the last count to be a combination of the entire complaint.” The suit was dismissed without prejudice which gives Newsmax the opportunity to file an amended complaint, but it must do so by September 11 and “must not contain any successive counts that incorporate all prior allegations.” Judge Cannon also adds that if an amended complaint is filed, “each count must identify the particular legal basis for liability and contain specific factual allegations that support each cause of action within each count.

A FOX spokesperson responded with the following: “Newsmax cannot sue their way out of their own competitive failures in the marketplace to chase headlines simply because they can’t attract viewers.” Newsmax issued the following statement in response to that saying, “If Newsmax was such a ratings failure, why has FOX spent so much time, energy, and resources to suppress us, block us, and denigrate us? The answer is obvious. Also please note that FOX in its statement does not deny any of our serious allegations.”

Further, Newsmax alleges that FOX News, “described in the complaint as a ‘must-have’ channel for distributors, leverages its market power to impose restrictions that harm consumers, stifle competition, and drive-up costs across the pay TV ecosystem.” Specifically, Newsmax alleges that “FOX conditions access to FOX News on 
agreements by distributors not to carry or to restrict competing right-leaning news channels. If distributors carry Newsmax, FOX forces them to also carry low-demand channels like FOX Business or FOX Sports 2 in their most widely viewed tiers, triggering potentially tens of millions in extra fees. These clauses penalize distributors for placing Newsmax in basic packages by requiring simultaneous promotion of FOX less popular channels.” Also, Newsmax alleges that FOX has pressured its guests to not appear on Newsmax, as well as has run online smear campaigns and hired private investigators targeting Newsmax executives to damage the Company’s credibility. Newsmax is asking the court to: 1) Declare FOX’s conduct unlawful under federal and state antitrust laws; 2) Award monetary damages as permitted by law; 3) Enjoin FOX from continuing exclusionary contracts and monopolistic practices; and 4) Order equitable relief to restore competition in right-leaning pay TV news.

However, Newsmax is not admitting guilt; just the opposite. “Newsmax believed it was critically important for the American people to hear both sides of the election disputes that arose in 2020. We stand by our coverage as fair, balanced, and conducted within professional standards of journalism.” The company says Delaware Court Judge Eric Davis would not provide a fair trial wherein the company could present standard libel defenses to a jury. Newsmax CEO Christopher Ruddy says, “The Delaware Court under Judge Davis effectively enforced a confiscation of our property because our reporting was not always sympathetic to Joe Biden. The actions taken against Newsmax, and earlier against FOX News, represent a direct attack on free speech and a free press.”

Heidi Harris Inducted Into the Nevada Broadcasters Hall of Fame. After 26 years in radio including stints at KXNT and KDWN in Las Vegas, veteran talk show host Heidi Harris was inducted into the Nevada Broadcasters Hall of Fame this past weekend (9/7). Harris tells TALKERS, “It’s an honor to be recognized by the Nevada Broadcasters Association, which works tirelessly on behalf of the broadcasting community, and awards generous scholarships every year to the next generation of broadcasters.” Harris continues to be a trailblazer presenting “The Heidi Harris Show” as an online streaming and video podcast production.

Newsmax separately filed a Motion for Sanctions against Smartmatic on May 13, 2024, and a Motion for Contempt against Smartmatic on July 16, 2024. Both of those motions remain pending. In its motions Newsmax argues that Smartmatic and its executives have misled Newsmax, the Special Master, and the Court about the Department of Justice’s ongoing criminal investigation into Smartmatic in which the agency alleges that Smartmatic and several of its senior executives participated in an international scheme involving a multi-million-dollar bribe allegedly made to an election official in the Philippines in exchange for the company getting nearly $200 million in contracts.
