KYW, Philadelphia Anchor Carol MacKenzie Sues Company for Discrimination

In a suit filed in U.S. District Court for the Eastern District of Pennsylvania, KYW, Philadelphia morning drive anchor Carol MacKenzie is suing employer Audacy for discrimination, claiming she’s been systematically paid less than her male counterparts and less than younger staffers doing similar work.im MacKenzie’s complaint paints a picture of her being consistently paid less than male and younger staffers that goes back to when she first joined the station when it was owned by CBS Radio. It says that from the beginning she was paid “about $20,000-$30,000 per year less than” her co-workers in comparable positions. MacKenzie says that the SAG-AFRTRA investigation into KYW’s compensation practices in 2021 confirmed her belief the company was engaged in gender-based pay inequity. In 2022 MacKenzie did agree to a deal with the company that paid her $150,000 per year for 2022, $152,500 for this year and $155,000 per year for 2024. But she says she has suffered “significant harms and losses” over the years and is seeking back pay, liquidated damages, interest, costs, negative tax consequence damages, injunctive and declaratory relief, and attorneys’ fees.

Testimony in Damages Phase of Alex Jones Sandy Hook Case in Texas Wraps. Plaintiffs in the Texas suit against InfoWars chief Alex Jones had won their defamation case and yesterday testimony in the damages phase of the trial wrapped up. They are seeking compensatory and punitive damages of $150 million for Jones’ false claims that the Sandy Hook school massacre was a staged event and their children were “crisis actors.” Plaintiffs testified that they have been threatened and harassed for years by Jones’ followers. The case, reported here by CNN, is being complicated by Jones’ attempt to file for bankruptcy for his Free Speech Systems (parent of InfoWars) which plaintiff attorneys claim is an attempt to hide his money from the courts. Plaintiff attorneys also say that Jones has drawn $62 million in assets from Free Speech Systems over the past two years in an attempt to hide assets from the courts. Jones was also found liable for damages in a Connecticut court and jury selection for the damages phase of that trial began yesterday.

INTERESTING – A Talk Radio Listener Wrote to TALKERS on Facebook: “Can I give your industry a clue? Lots of people still listen to the radio every day at work. You think because nobody calls the station anymore that you have no listeners. Businesses nowadays have all their employees under video surveillance and if they see you on the phone you are subject to disciplinary action. We still hear you, but we can no longer interact with you.”

RIP Vin Scully. In recognizing the passing of the legendary Dodgers play-by-play man, consultant Holland Cooke writes: “He was the voice of the Dodgers, from Jackie Robinson to Clayton Kershaw. Though LA listeners knew him best, fans everywhere remember his historic World Series calls. 1988 Game 1 was one for the ages. Working solo for decades as two- or three-voice broadcast teams became the norm, Vin Scully sounded like he was watching the game sitting next to you. The Athletic called him ‘the solitary voice emanating over the airwaves. He was renowned for his spellbinding monologues, his folksy wisdom and his sense of the moment — some of Scully’s most famous calls revolved around silence, his usage of the crowd to tell a story that words could not justify.’”

Public Radio Syndication Pioneer Larry Josephson Dies at 83. Later, the program was given nightly status airing at 9:00, but conservative Wynter and more liberal Massey remained part-time employees. Along with this promotion, “Word on the Street” assumes the 7:00 pm to 10:00 pm slot, effective June 13. But I kept pushing and keeping an eye on the prize. This has been very emotional.”

Alex Jones Trial Damages Phase Set for September After Bankruptcy Scheme Fails. Several reports, including this one from Kate Marino at Axios, reveal that Alex Jones’ attempt use bankruptcy laws to avoid what could be large damages paid to families of the Sandy Hook school massacre victims, has failed and the September damages trail in Connecticut remains  scheduled. At issue here was Jones’ strategy to use a new subchapter of the U.S. bankruptcy code to declare Chapter 11 for three of his companies that did little or no business and thereby triggering an “automatic stay” on the case. But the subchapter was designed to help struggling small business delay payments to creditors while reorganizing and not as a strategy to simply delay a trial. In addition to the Justice Department’s bankruptcy watchdog seeking to dismiss the bankruptcy cases for Jones’ companies, the Sandy Hook families also dropped their suits against those companies but are continuing to seek damages from Alex Jones himself. The piece notes that in the Connecticut state court damages trial, “Jones may face much higher penalties than the $10 million he offered in the bankruptcy deal.”

Alpha Media Flips CHR KTFM to Sports Talk as Simulcast of KZDC-AM in San Antonio. Sports talk outlet KZDC-AM “San Antonio Sports Star” gets a full-market FM signal as Alpha Media flips CHR KTFM at 94.1 to a simulcast of KZDC. Afternoon host Jason Minnix writes a blog piece on the station’s site announcing the additional signal. He says, “Moving to 94.1 is huge – the signal is 37 times bigger than what we had yesterday. You know I am a music guy so this is like a band that started playing clubs, moved to arenas and is now playing massive stadiums. Like going from Wolff Stadium to Jerry’s World… This move to 94.1 gives San Antonio one of the biggest sports stations signal wise in the state. Dallas has a sports station with a bigger signal. Houston doesn’t. Austin doesn’t.”
