Trump Selects Brendan Carr to be FCC Chairman

Brendan CarrLast night (11/17), President-elect Donald Trump announced his selection of Brendan Carr to be the chairman of the Federal Communications Commission (FCC).  Trump praised Carr as a “warrior for free speech” and someone who has “fought against the regulatory lawfare that has stifled Americans’ Freedoms and held back our Economy.”  Trump further stated, Carr will “end the regulatory onslaught that has been crippling America’s Job Creators and Innovators and ensure that the FCC delivers for rural America.”  Carr is currently the leading Republican in the FCC. He is one of five commissioners leading the agency, all of whom are appointed by the president pending Senate confirmation.  In response to the nomination, Carr thanked Trump in a post on X, saying, “I am humbled and honored to serve as chairman of the FCC. Now we get to work.”  In a follow up post, Carr stated, “We must dismantle the censorship cartel and restore free speech rights for everyday Americans.”  Carr was the central figure in the complaint against NBC’s “Saturday Night Live” for having VP Kamala Harris in a skit on the program without extending a similar opportunity to Donald Trump to remain in accordance with FCC rules to ensure equal time is granted on networks.  At that time, Carr posted to X, “This is a clear and blatant effort to evade the FCC’s Equal Time rule,” he said on X. “The purpose of the rule is to avoid exactly this type of biased and partisan conduct – a licensed broadcaster using the public airwaves to exert its influence for one candidate on the eve of an election.”  (EDITOR’S NOTE:  Some of the recent information being disseminated about broadcasting “networks” being licensed by the FCC has been misstated or misinterpreted by politicians and the media alike.  For the most part, TV networks are non-licensed content providers.  The licenses are held by the individual stations, groups of stations and their owners with whom they affiliate.)

Biting Music Video “Idiots” Passes 100k Views on YouTube

Fueled by a tremendous amount of attention and airplay on news/talk radio, the song “Idiots” by the perennial pop music ensemble Gunhill Road, with a worldwide internet following for its provocative songs addressing societal issues, has cracked the 100k plateau in gathering views on YouTube and downloads on various other platforms.  Released in 2022, the song continues to be an extremely active item on both talk radio and the internet.  The catchy pop tune takes a powerful stand with a combination of humor and hard-hitting commentary about the dangers facing American democracy bedeviled by ever-lowering standards of education and intelligence.  “Idiots” can be heard and viewed by clicking here.

New Gunhill Road song celebrating talk radio dropping soon.  The group is currently in the final stages of production with an anthem celebrating talk radio. Audacy Names Dave Sims New PBP Voice of the New York Yankees on WFAN

Dave Sims IDAudacy’s WFAN 101.9 FM / 660 AM announces Emmy Award-winning broadcaster Dave Sims as the new lead play-by-play announcer of its flagship broadcasts of the New York Yankees. Sims replaces recently retired broadcasting legend John Sterling, who held the position from 1989 until his retirement this past season. Dave Sims will join Suzyn Waldman to form the franchise’s new radio broadcast team.  “The radio voice of the Yankees is a storied position in the history of baseball,” said Chris Oliviero, Audacy New York Market president. “From [Mel] Allen and [Red] Barber to [Phil] Rizzuto to Sterling, the names are synonymous with the pinstripes. Urban One Reports Net Revenue Down 6.3%

Urban One reveals its financial data for the third quarter of 2024 and reports net revenue of $110.4 million, aim decrease of 6.3% from the same period a year ago. Revenue from radio advertising was $36.4 million during the quarter, down 3.6% from the same period in 2023. Urban One reports a net loss of $31.4 million, a substantial decline from the $53.7 million net loss it reported in Q3 of 2023. Urban One owns and operates news/talk outlets WBT-AM/FM, Charlotte and WIBC-FM, Indianapolis.

Tolbert, Lund and More Exit KNBR, San Francisco

According to a report from SFGate.com’s Alex Simon, Cumulus Media’s Bay Area sports talk outlet KNBR has parted ways with a number of staffers in a wide-ranging, budget-related downsizing. Afternoonim personality Tom Tolbert – who co-hosted the “Tolbert & Copes” show with Adam Copeland – and midday personality John Lund – co-host of “Papa and Lund” are both out. Additionally, the San Francisco Chronicle reports that the company also cut producer Danny Dunn, executive Lee Hammer, morning show producer Erik Engle and digital team members Jake Hutchinson, Danny Emerman, Austin Scott and Maureen Mahoney.

Jim Bohannon Tribute Podcast Posted on TALKERS MEDIA YouTube Channel

November 12 marked the second anniversary of the passing of legendary Westwood One syndicated radio talk show host Jim Bohannon who, after waging a brave battle, succumbed to esophageal cancer in 2022. Bohannon’s stellar career in radio covered a span of almost 63 continuous years during which he was honored with just about every award the industry has to offer including induction in the Radio Hall of Fame, the NAB Broadcasting Hall of Fame, and the Missouri Broadcasters Hall of Fame. He is a recipient of the Radio Television Digital News Foundation’s Lifetime Achievement Award as well as the TALKERS Lifetime Achievement Award (which has subsequently been renamed in his honor). TALKERS publisher Michael Harrison conducted the final interview ever recorded with Jim Bohannon one month before the talk show giant’s passing. In it, the two friends and broadcasting industry colleagues engaged in a heartfelt, remarkably candid conversation about life and death, in addition to sharing observations about the changing state of radio. Reflecting on that interview, Harrison states, “For all his accomplishments on and off the air, what I remember most about Jim was the sheer bravery and good-natured wisdom that he publicly displayed during the final months, weeks, and days leading up to his death in 2022. We capture that intimacy and spirit in this interview.” Harrison adds, “Jim Bohannon’s life and work embodied the absolute best aspects of talk radio’s modern era.”  In recognition of the second anniversary of Jim Bohannon’s passing, this new podcast episode honoring the great radio star consists largely of that final interview along with a general remembrance of his outstanding career and legacy.  It has now been posted on the new TALKERS MEDIA YouTube channel.  To listen to it, please click here.

WABC Salutes Veterans with Live Broadcast from the Veterans Day Parade in New York

Continuing with its policy to be as involved and visible as possible in the community, WABC, New York presented a live broadcast from Monday’s (11/11) Veteran’s Day Parade in the Big Apple. Gary Sutton Exits WSBA, York

According to a report from WHTM-TV, WSBA, York, Pennsylvania morning host Gary Sutton was let go fromim the Cumulus Media news/talk station on November 7.  Sutton began working full time at the station in 1997. He tells WHTM that he does not plan on retiring. “Tomorrow is the first time in 52 years that I don’t have to work, but I hope that doesn’t last long because I am not retiring. God is in control, and I know there are new opportunities ahead and a new chapter in my life.” Sutton says he and producer Mark McKenzie were dismissed due to budget cuts.

Former Badgers Coach Alvarez Joins ESPN Madison

Former Wisconsin Badgers head coach and director of athletics Barry Alvarez joins ESPN Madison and Good Karma Brands as an on-air host and brand ambassador. The company says he will be featured acrossim ESPN Wisconsin programming, including weekly appearances on “The Great Dane Huddle” on ESPN Madison with former Badgers Derek Engler and Tarek Saleh. Good Karma Brands founder and CEO Craig Karmazin says, “Barry’s significance to the Wisconsin sports landscape and to Good Karma Brands can’t be overstated. I would not have visited Wisconsin as a college student and eventually started a company here had it not been for the way he and Pat Richter transformed the Wisconsin football program. WRKO, Boston Raises More Than $67,000 for Disabled Veterans

iHeartMedia news/talk outlet WRKO, Boston raised more than $67,000 during the station’s ninth annual DAV Radiothon to benefit the Disabled American Veterans Department of Massachusetts. The radiothon took place on Friday (11/8) and featured talk hosts Jeff Kuhner, Chuck Zodda, Mike Armstrong, Grace Curleyim and Howie Carr encouraging listeners to donate and raise funds for the DAV of Massachusetts’ homeless shelter and transportation programs. iHeartMedia Boston director of operations, news, talk and sports Bill Flaherty says, “Once again, the WRKO listeners responded in support of our Veterans. Their generosity provides much needed services for those who sacrificed so much for our country.” Since 2016, the DAV Radiothon has raised over $1,125,000 to benefit veterans in the community.

MONDAY MEMO: Optimize Your Brain

imDo you wish you could get in just one more hour of focused work… but your brain won’t cooperate? You’re not alone.

21st century productivity – especially for those of us in talk media where the action never stops – demands that we work against the way we’re wired. “For the brain to produce work of quality,” physician and neuroscience researcher Dr. Mithu Storoni says, “it needs to work in its own way.”

She observes how we’re expected to solve problems as though we’re feeding an industrial-era conveyor belt. But ideas can’t be manufactured in assembly-line fashion. Her solution? Rather than imposing the rhythms of work on our brains, we should impose the rhythm of our brains on our work.

Simple tips from her book, Hyperefficient: Optimize Your Brain to Transform the Way You Work:

Keep shifting gears. Our brains function like a car’s engine, different gears for different mental challenges. We’re better-off doing short bursts of intense work followed by longer periods of light work.

• Take a walk. Have you noticed that you have some of your best ideas when you do? Sitting upright in an office chair staring at a computer doesn’t let the mind wander.

Coffee is a friend. Storoni finds “no evidence that caffeine ingestion upon waking is somehow responsible for an afternoon ‘crash’ — or that delaying consumption would somehow prevent this if it did occur.”

Tech can be a foe. Screens are making us jittery. The quantity of information they deliver can hinder the quality of our ideas. Did you ever read an email… see red… then fire-off an ill-advised reply? And social media “has this power to distort space and time,” causing us to feel “that something we are seeing is happening now and near to us. The problem is if this event is taking place halfway around the world, you cannot do anything to make the situation better.”

Practice paying attention. “It takes some effort to focus. If I were to say, ‘Focus on that spot on the blank wall’, you’d need to work at it,” Storoni says. “Now information is cheap and attention is expensive, so everything is competing to grab our attention.”

Never ignore mental fatigue. If you do more than four hours of “mental heavy lifting” every day, Storoni says the mind can’t recover even after a night’s rest, and fatigue drags into the next day.

Hillsdale Radio Performs Big Time Election Night Coverage

HillsdaleJournalism is alive and well within certain college radio circles. On Election Night (11/5), the WRFH/Radio Free Hillsdale 101.7 FM student broadcast team hosted live coverage from the Searle Center on Hillsdale College’s campus in Hillsdale, MI and invited students, faculty, and staff to attend and watch election results roll in and listen to analysis. Student anchors were joined by the presidents of Hillsdale College Republicans and Hillsdale College Democrats, three members of the Hillsdale faculty, a candidate for the Michigan State House, a candidate for the Michigan Supreme Court, and reporters from the Detroit News, the Daily Caller, the Center Square, and the Daily Signal. Back at the WRFH studios, the station’s news team worked to update listeners with results from state and local races all night long. More than 200 people came out to the broadcast in action. WRFH GM Scot Bertram tells TALKERS, “It was a home-run event!  Students work hard to prep for this quite unpredictable night. There’s an enormous amount of planning and research involved to set everything up. Then the night unfolds, and they realize it’s a ton of fun, as well. I’ve heard from more than a few students who took part in our previous Election Night events that it’s one of their best experiences on campus and really drew them deeper into the journalism program here at Hillsdale.”

NYPost: “iHeartMedia Slashes Hundreds of Jobs”

The New York Post is reporting that iHeartMedia has cut “hundreds” of jobs in a move executed on Monday (11/4). The Post writes, “The company headed by CEO Bob Pittman has cut less than 5% of a workforce ofim more than 10,000 employees, a source with knowledge said, amounting to hundreds of job losses as the company streamlines its business and eliminates redundancies. The story also quotes iHeartMedia spokesperson Wendy Goldberg, saying the company has focused on expanding its Gen Z audience and that its broadcast radio audience has “more listeners than it did 10 years ago. Although in a company of 10,000 people very few jobs have been affected, there have been some and we never take this step lightly no matter how few jobs it entails; every team member is important to us and has our respect and appreciation.” Read the Post story here.

FAIR USE: What Constitutes “Publishing” or a “Publication” on Today’s Media Playing Field?

imAs the practice of “clip jockeying” becomes an increasingly ubiquitous and taken-for-granted technique in modern audio and video talk media, an understanding of the legal concept “fair use” is vital to the safety and survival of practitioners and their platforms.

When assessing fair use in audio media, courts closely examine the “nature of the copyrighted work,” especially focusing on whether the work is factual or creative, and published or unpublished. Factual content, such as news reports or data, is more likely to be seen as fair use material, as it’s in the public interest to keep factual information accessible. Creative works, like music, fiction, or original performances, often enjoy stronger protection because they embody the creator’s unique expression and should be compensated accordingly.

Unpublished interviews or speeches.  When audio content includes unpublished material – such as a speech or interview that hasn’t been publicly released – courts typically approach it with heightened caution. For example, if a podcast includes clips from an unpublished interview with a politician to enhance commentary, courts might scrutinize this more heavily than they would a published work, as the speaker retains significant control over whether and how the content reaches the public.

Case study insight: Salinger v. Random House (1987).  The landmark case Salinger v. Random House highlighted how unpublished works generally receive stronger copyright protection. In this case, the use of unpublished letters in a biography was ruled as infringing, emphasizing that unpublished materials hold a unique status in copyright law. If a podcaster today were to use a similarly unpublished interview with a public figure without significant commentary or transformation, they might face greater legal challenges.

Redefining “published” in the digital era.  With digital platforms, the meaning of “published” is evolving. Traditionally, a work was deemed “published” when made available for sale, license, or public distribution. Now, sharing content online, even in a limited way – such as within a closed social media group or private online forum – raises questions about whether the content should be considered published. Courts are increasingly aware that limited digital sharing doesn’t necessarily reduce a work’s unpublished protections, but extensive online distribution might.

Modern considerations of online sharing. Courts today analyze factors like control over access and the sharing platform’s nature. For instance, an audio clip shared in a restricted forum might retain its unpublished protections, while a widely posted clip could lose some of those protections. Additionally, when creators post content on platforms like Instagram or YouTube before officially “publishing” it elsewhere, courts may take the creator’s intent and distribution scope into account when determining the content’s legal status.

As online platforms reshape how creators distribute their work, they also impact fair use, pushing courts to reinterpret what it means for a work to be “published.” This evolving understanding means that copyright protections depend not only on whether a work is accessible but also on the level of control over its distribution, especially for audio content.

Beasley Broadcast Group Reports Third Quarter Revenue of $58.2 Million

Beasley Broadcast Group reported $58.2 million in revenue for the third quarter of 2024, down 3.2% from last year.Beasley This drop is partly due to selling their Wilmington station and closing some digital businesses. Despite this, Beasley saw growth in digital and political advertising. They earned $1.2 million in operating income this quarter, a significant improvement from last year’s $85.5 million loss, which included large non-cash impairment costs. This quarter’s net loss was $3.6 million, much lower than last year’s $67.5 million loss, as Beasley reduced expenses and interest costs. Digital revenue continues to grow, now making up 19.4% of total revenue. Beasley’s CEO, Caroline Beasley, noted that digital transformation and political ads helped offset challenges in traditional radio advertising. She emphasized ongoing efforts to streamline operations, improve finances, and focus on their digital platforms. To see the full report please click here.

Boston Sports Talk Legend Fred Toucher on the Demise of His Old Partner’s New Show: “I Hate Him”

In an example of just how contentious sports talk radio can be, long-time Boston sports talk radio host Fred Toucher did not hold back in slamming his old partner, Rich Shertenlieb, whose new show was cancelled this week. Fred Toucher ID (From Seminar 2024)Toucher, who now co-hosts “Toucher & Hardy“ on 98.5 The Sports Hub, WBZ-FM, Boston took some time on this morning’s show (11/5) to address ”the elephant in the room.” Shertenlieb‘s new show on local classic rock outlet WZLX had been canceled after five months, and Toucher didn’t seem to have any sympathy for his former partner.  In a story by reporter Nick O’ Malley posted on the news site MassLive.com, “I hate him,” Toucher said. “So, I was happy yesterday when I heard about this. But I was a little disheartened that he still carries none of the responsibility and takes none of the blame and still just can’t be honest.”   Toucher and Shertenlieb co-hosted the “Toucher & Rich” show from 2009-2023, working together to produce one of Boston’s most popular morning shows. However, the show ran into issues in 2023. Toucher missed time due to personal and physical issues, including a stretch of time at an alcohol detox facility. In November, parent company Beasley Media said in a statement that Shertenlieb declined to accept a new contract.  On Monday, Shertenlieb announced that he was “disappointed” that his show was being canceled after just five months. The radio host complained that management forced him to “alter the format” of the show by adding music.  However, Toucher noted Tuesday that Shertenlieb’s show was a “ratings disaster.”  “He not only did not bring in a new audience to that show, he alienated – based on ratings – their entire existing audience,” Toucher said. “He had like a third of the ratings that they got jockless in the morning … Yeah, management might have been a little concerned.”  Toucher said that critics can paint the picture of his reaction however they like. NYTimes: “Interview” With a Dead Luminary on Polish Radio Station Ignites Backlash Against A.I.

According to an article published yesterday (11/3) in The New York Times written by reporter Andrew Higgins, when a state-funded Polish radio station canceled a weekly show featuring interviews with theater directors and writers, the host of the program went quietly, resigned to media industry realities of cost-cutting and shifting tastes away from highbrow culture. But his resignation turned to fury in late October after his former employer, Off Radio Krakow, aired what it billed as a “unique interview” with an icon of Polish culture, Wislawa Szymborska, the winner of the 1996 Nobel Prize for Literature. The terminated radio host, Lukasz Zaleski, said he would have invited Szymborska on his morning show himself, but never did for a simple reason: She died in 2012. The station used artificial intelligence to generate the recent interview – a dramatic and, to many, outrageous example of technology replacing humans, even dead ones. Zaleski conceded that the computer-generated version of the poet’s distinctive voice was convincing. “It was very, very good,” he said, but “I went to her funeral, so I know for sure that she is dead. ”The technology-enabled resurrection of the dead poet was part of a novel experiment by Off Radio Krakow, an arm of Poland’s public broadcasting system in the southern city of Krakow. The aim was to test whether A.I. could revive a moribund local station that had “close to zero” listeners, according to the head of public radio in Krakow. The station also planned from-the-grave interviews with other dead people, including Jozef Pilsudski, Poland’s leader when it regained its independence in 1918. Novelty value – and a storm of public outrage – worked to bolster Off Radio Krakow’s audience, which the head of Radio Krakow said grew to 8,000 overnight from just a handful of people after the introduction of three A.I.-generated Generation Z presenters – Emilia, 20, Jakub, 22, and Alex, 23, each of whom had a computer-generated photograph and biography on the station’s website. MORE ON FAIR USE: Using the Audio/Video Content of Others Can Transform a Work into a Sum Greater Than Its Parts – Or Be a Legal Headache

This factor assesses whether the use is “transformative”—adding new expression or meaning—or merely reproduces the original’s essence, potentially infringing on copyright.

Examples from popular platforms provide guidance. Podcaster Joe Rogan, for instance, often uses clips to build commentary and analysis, which could support a fair use defense due to its transformative nature (though others may argue the additions don’t significantly alter the original). Defining “transformative” is challenging, especially when the original creator disagrees on whether substantial new meaning has been added.

Transformative use in podcasts.  In podcasting, many creators use news clips or sound bites to provide commentary or critique, adding analysis or humor that can help support a fair use claim. For example, “The Joe Rogan Experience has used various clips and video snippets with added commentary. While Rogan’s show hasn’t faced significant legal challenges for these uses, adding commentary could bolster a fair use defense.

Hypothetical: satire on a radio show. Consider a radio show that incorporates political speech snippets for satire. If the use is genuinely transformative, adding new expression or meaning, it may meet fair use standards. However, the line is thin, especially if the clip isn’t significantly altered. Precedents like Campbell v. Acuff-Rose Music, Inc. inform how courts may handle parody and transformation in fair use.

Example: news clip commentary in political podcasts.  Political podcasts like “The Daily” from The New York Times often use brief clips to provide in-depth commentary on current events. For instance, they might use a clip from a politician’s speech to add a critical or alternative perspective. In such contexts, courts are more likely to view the use as transformative, particularly if it builds on or challenges the original content. These scenarios illustrate the balance media creators must strike in using third-party audio. Whether adding commentary, satire, or criticism, the goal is to transform the original content meaningfully, beyond simple replication. Understanding fair use’s “purpose and character” factor helps media creators leverage third-party content responsibly, aligning with legal standards.

Nielsen Publishes “The Record” – Q3 U.S. Audio Listening Trends

Yesterday (10/30) Nielsen published The Record: Q3 U.S. Audio Listening Trends. The Record is a quarterly report card on how U.S. consumers spend their audio listening time, fueled by data from Nielsen and Edison Research.

Here are some highlights from the Q3 report:

Audio accounts for nearly 20% of daily time; in Q3 2024 that translated to 3 hours and 57 minutes of daily listening across both ad-supported and ad-free platforms like radio, podcasts, streaming music services and satellite radio.

From July to September 2024, listeners spent 67% of their daily time with ad-supported audio with radio, 18% with podcasts, 11% with streaming audio services and 3% with satellite radio.

Among 18-34 year-olds, radio now accounts for the majority of daily time spent with ad-supported audio, growing to 51% in Q3 vs. 48% in Q2.

Listening share for podcasts among 18-34 audiences decreased for the second consecutive quarter to 31%, down from 35% in Q2 and 37% in Q1.

• Positive: With the clock set back, it becomes lighter earlier in the morning, which can help people wake up more easily and feel more alert, especially for those who need to start their day early.
• Negative: For people who start their day later, they may not notice much of a change, but the adjustment period can still be disruptive.

 

Shorter Evenings:

• Positive: The extra hour of light in the morning might be useful for early morning commuters, outdoor activities, or children heading to school.
• Negative: On the downside, the sun sets earlier in the evening, meaning it gets dark sooner. This can affect evening activities and make commutes home feel less pleasant or even more dangerous due to reduced visibility.

 

Disruption to Sleep Patterns:

• Positive: The “fall back” of the clock gives people an extra hour of sleep, which many enjoy.

What’s a radio station to do?

• Explain the history of DST.

• Ask listeners’ opinions on DST. Do they love it or hate it? You’ll hear both.

• “How will you spend your extra hour?”

• Give away nostalgic items (like retro vinyl records or vintage tech).

• Sleep tips from health professionals and mental health experts.

• Advertisers offer “10% off for the extra hour! Sale only valid from midnight to 1:00 am.”

• Coffee or breakfast gift card giveaways.

• Pertinent commercial copy hooks, i.e., “It’s time for a new ___!”

TALKERS Legal Series on Fair Use (Part 4): The Amount and Substantiality Factor

Harrison, Esq.With the growing popularity of talk media programs utilizing segments of other shows as key elements of scrutiny and commentary in their programming (“Clip Jockey Format” as coined by Michael Harrison), it is important that media content creators be aware of the subtle and often ambiguous rules applying to the legal aspects of this practice under the heading of fair use.

This is the fourth installment of a multi-part TALKERS Legal Series on Fair Use for the Media Creator. The first installment is here. The second installment is here. The third installment is here.

The “amount and substantiality” factor in fair use focuses on how much of the copyrighted material is used and whether that portion is essential to the original work. Despite seeming obvious, this factor can be nuanced, and determining how much use is fair can be challenging because it’s not just about the quantity but also about the significance of the portion used.


Is It Difficult to Distinguish?

In many cases, it’s not always obvious what qualifies as a “small” or “insignificant” portion. Courts often consider both the quantity, and the quality of the material used:

• Quantity: This factor asks if only a small part of the work has been used. Using a shorter clip from a video or a few sentences from a book could be more justifiable as fair use. But what qualifies as “small” can vary depending on the work—10 seconds from a short film may be seen differently from 10 seconds in a longer documentary.

• Quality: Even if a creator only uses a small part of the original work, using its “heart” or most memorable part might still count as substantial. For example, a few lines from a song’s chorus, though short, could be considered significant enough to impact fair use status.

Example Cases Highlighting Amount and Substantiality

To better understand this, it’s useful to look at cases that illustrate when the amount used was deemed fair or not:

• Harper & Row v. Nation Enterprises (1985): This case involved a magazine that used a few hundred words from an unpublished memoir by President Gerald Ford. Although this was a small percentage of the memoir, the excerpt contained key insights into Ford’s decision to pardon Nixon. The court held that this use was not fair because it included the most “substantial” and critical part of the memoir, even though the total percentage of text used was minimal.

• Campbell v. Acuff-Rose Music, Inc. (1994): Here, the hip-hop group 2 Live Crew used portions of Roy Orbison’s song “Oh, Pretty Woman” to create a parody. Even though the song’s recognizable parts were used, the new work was transformative in its purpose (a parody rather than a love song). Because the group’s use was a small part relative to the song’s total content and had a new purpose, the court found it was fair use.

Many books and law school classes have been devoted to this question – so let’s focus on Application in Media and Broadcasting

In radio and broadcasting, this factor is often relevant when using clips, songs, or interview segments from other sources. Using a small clip to support commentary or criticism is more likely to be considered fair use, especially if it does not contain the “heart” of the original work:

• Commentary on a Speech: If a talk show uses a brief part of a public figure’s speech to critique it, the fair use factor may weigh in favor of the radio station if it doesn’t take the most memorable segment.

• Use of Music in Shows: Music clips used for thematic transitions or commentary must be kept brief, as lengthy or highly recognizable parts can affect fair use status. Playing just a few bars might qualify, but a chorus or instrumental hook would likely cross the line. This is less of a mine field in traditional broadcast radio as existing license agreements, such as with ASCAP or BMI, may allow for such uses anyway. However, when focusing on the internet – it’s a completely different matter as no licenses have been formally given, yet there is an incentive for the copyright holder to have their work shared. It’s not cut and dry – which is why the following takeaways should be helpful when navigating forward.

• Use Minimal Amounts: The less you use, the more defensible your case for fair use, especially if you avoid the most recognizable parts.

• Avoid the “Heart” of the Work: Select portions that serve your purpose without including critical or memorable parts of the original material.

• Transformative Purpose Matters: If the use adds new meaning or serves a different function (e.g., satire, critique), it’s more likely to be deemed fair, even if it includes some key elements.

Summary

Understanding how much of the work a media creator can use while staying within fair use guidelines can be tricky, as this factor requires balancing quantity and significance. SABO SEZ: Move or Die!

Walter M. SterlingIf a shark doesn’t swim, it dies. Radio is just fine, thank you, but it’s not swimming. Water, check. Tank, check, Sharks, check. Swimming to the next meal, nope. For the past 10 years at least, the radio show in every city is stuck in place and that sound in the distance that wakes you up at night is a death rattle.

The public perceives radio to be live, current, and local. Those three ingredients are the foundation of radio’s hundred years of success and the envy of all other media. That’s right – ALL. OTHER. MEDIA.  Radio was born with the characteristics envied by newspapers, magazines, streaming, TV… name it.

The savior of the AM band was not a three-hour-a-day-host. The savior is all-news and local live. The FM formats that thrive and grow put up a live mirror to a city’s needs and tastes.  Stations that sound like their city, and no other city, do not just win – they dominate. The radio shark is the forward momentum of urgent local information, new ideas, new jokes.

When asked, most people will say, “I don’t think I listen to the radio much…” But they do. The problem is radio is not top of mind. Why not? Because radio must demand listener attention with urgent, new ideas, entertainment, and information. “Your favorites from the 90s and today” isn’t doing that. Listen to air checks of the double-digit share legends of top 40 night-time radio. They weren’t so great. BUT in every single break they announced the names of local schools, listeners, events – every break with urgency. The more listener names, the higher their shares. Radio math. The more listener names, the more live local points of reference, the higher the audience share.

Consider the stunning ratings of too many NPR stations. What accounts for their growth trajectory? Clock the percentage of time your local NPR station spends presenting local news, local information, and new ideas.

Compare that with any other station in the city. In its own dreary way, most NPR stations deliver on the presumed benefits of the medium of radio: Local, live, urgent ideas. Yes, many commercial stations command major ratings for the same reason: All-news stations, and hybrids such as WSB, Atlanta; KRLD, Dallas; New Jersey 101.5, WABC, New York; KFI, Los Angeles; WTAM, Cleveland; WPHT Philadelphia.

New Ramsey Solutions Research Shows Nearly 80% of U.S. Adults Say They’re Worried About The Economy

Two weeks before Americans head to the polls to elect a new president, 78% of adults say they’re worried about the economy according to Ramsey Solutions’ new State of Personal Finance report for the third quarter of 2024. Ramsey SolutionsThe research notes millennials (ages 27-42) are the most concerned at 83%.  The survey finds people are feeling the effects of the higher costs of goods and services, and they remain concerned about inflation. In addition, 37% said their finances are in worse shape than four years ago. Thirty-four percent said their finances are about the same, while only 29% said they’re better off than they were four years ago. The research indicates more than half (52%) of Americans believe the U.S. presidency has a major impact on their personal finances. “We encourage every American to go out and vote,” said Dave Ramsey, personal finance expert and host of “The Ramsey Show.But remember, what goes on in your house is a whole lot more important than who’s in the White House. The research shows that less than half of Americans believe a written household budget is the way to win with money. That has to change, or nothing will.”

Other key findings include:

• 1 in 3 Americans can’t afford Christmas and plan to use credit cards to make up for the shortfall.

• Nearly half of Americans (49%) report some difficulty paying bills, with Gen Z struggling the most (69%).

• 34% said they have at least $10,000 in consumer debt.

• Only 1 in 10 U.S. adults are investing 15% or more of their income.
