Tavis Smiley to Interview Excluded California Gubernatorial Candidates

Today (3/25) at 10:00 am PT, KBLA, Los Angeles-based, nationally syndicated talk radio host Tavis Smiley will interview the four candidatesimg who were excluded from the recently canceled March 24 KABC-TV | University of Southern California gubernatorial debate. Smiley says he’ll speak with Xavier Becerra, Tony Thurmond, Betty Yee, and Antonio Villaraigosa separately in four 15-minute segments about the race, their campaigns, and their plans for California’s future. He adds, “It’s no coincidence that the four gubernatorial candidates who were excluded from a debate hosted by ABC7 and USC – canceled due to public outcry – are now appearing on KBLA Talk 1580, a Los Angeles-based, Black-owned, progressive radio station, to discuss their campaigns and the race for California’s top office.”

KMJ-AM/FM, Fresno Helps Raise Funds for Central California Food Bank

Cumulus Media’s KMJ-AM/FM, Fresno “NewsTalk 580/105.9 KMJ” recently partnered with local agriculture company GAR to present the 12th Annual Feeding Families Fund Drive and raised a record-breaking $534,917 for the Central California Food Bank. KMJ broadcast live from The Market in Fresno on September 19. Over the past 12 years the annual event has raised more than $35 million for the Central California Food Bank. RTNA Opens Awards to All of California

imgThe Radio & Television News Association of Southern California (RTNA) is opening its awards program to television and radio stations outside of Southern California for the first time in 76 years. RTNA says its Golden Mike Award is the longest running broadcast news award in the United States. It says the new statewide radio categories includes Best “Live” Coverage of a News Story (Team effort on a breaking news story. Must be live, on-scene coverage and not taped or anchor coverage); Best News Reporting (Individual reporter’s enterprise on a single, one-time news story produced by the news department); Best Feature Reporting (Individual reporter’s effort on a single subject produced by the news department); and Best Radio Use of Sound (Capturing drama and emotion in – ambient or natural sound – coverage of news events in the field and/or technical and artistic excellence in production, mixing and editing). KTKZ, Sacramento Helps Draw Crowd to Protest California Bill

Salem Media Group says its news/talk KTZK, Sacramento “1380 The Answer” help bring the crowd pictured above to the California State Capitol Building to support the protest against AB 495 organized by Calvary Chapel Chino Hills pastor Jack Hibbs yesterday (8/19). Salem Radio Network VP/news & talk programming Tom Tradup says the rally was “the latest example of how talk radio’s one-on-one relationship with listeners can help promote citizen action when lawmakers endanger the rights of parents and children in California or anywhere else across America.” The bill was subsequently returned to committee pending further study.

KMJ listeners responded to the one-day broadcast with generous donations to help their less fortunate neighbors, raising over $200,000 in a single day. Gar Bennett matched every donation with 50 cents on the dollar, for a grand total of $493,000 going to the Central California Food Bank. Co-sponsor Farm Credit also pitched in with a large donation to the cause.  The annual one-day event has raised more than $4.5 million for the Central California Food Bank, providing 20 million meals in 11 years. Santa Maria, California Talk Station to Go Dark

Knight Broadcasting’s Sandra Knight tells KSBY-TV that the company is shutting down talk KUHL, Santa Maria, California. Knight put the company’s three stations – KUHL-AM, adult contemporary KSYV-FM, and country KRAZ-FM – on the market after her husband’s death two years ago but has not had luck selling the three as a package deal. A station employee is buying KRAZ and the company is donating KSYV to California Lutheran University. Knight tells KSBY-TV, “I realize that KUHL is a long-standing station in the Santa Maria community and this pains me very much.” Read the KSBY-TV story here.

KMJ-AM/FM, Fresno Raises $620,000 for Central California Food Bank

In the last decade, KMJ’s Feeding Families Fund Drive has raised a total of over $4.4 million to help feed area families in need. The fundraiser is conducted every year in partnership with the Musson family at agribusiness firm GAR Bennett, which very generously matches 50% of the total funds raised through the drive.

Meta May Delete News From Its California Apps

In a warning issued yesterday (Wednesday, 5/31), Meta claims it will pull news links from Facebook and Instagram in California if lawmakers in The Golden State move forward with a bill that would tax the company for news content. The proposed California Journalism Preservation Act would require online platforms to pay a “journalism usage fee” to news providers whose work appears on their services. Under the measure, an estimated 70% of the money collected from that fee would support newsrooms throughout California. Meta argued the bill will aid out-of-state companies and says if the Journalism Preservation Act is enacted, it will remove news from Facebook and Instagram altogether. While the bill has been praised from some of California’s largest journalism unions such as Media Guild of the West and Pacific Media Workers Guild, non-profit media advocacy organization Free Press Action has criticized it, per CNN, as doing “nothing to support trustworthy local reporting and would instead pad the profits of massive conglomerates.”

Larry Elder Fined by California’s Fair Political Practices Commission

According to a story in the Los Angeles Times, former Salem Radio Network host and current GOP presidential candidate Larry Elder was fined $2,000 for violating California’s Political Reform Act duringim the 2021 recall election. The story indicates that Elder “failed to disclose earnings from 10 entities on his statement of economic interest, including Salem Media, Epoch Times and Turning Point USA, according to the state election commission.” The commission found “no evidence of intent to conceal” and the financial disclosure documents have been corrected. KSCO, Santa Cruz Marks 35th Year of Ownership by Zwerling Broadcasting System (ZBS)

January 31 marked the 35th anniversary of local real estate businessman-turned-broadcaster Michael “MZ” Zwerling‘s purchase of KSCO-AM 1080, Santa Cruz. Zwerling, pictured below with Amy Hau, his life partner and co-host on KSCO’s “Saturday Special,” grew upimg listening to the 10k flamethrower, with a history dating back to 1947, that blankets the Santa Cruz / Monterey / Salinas market and most of the Central California coast. Since acquiring the station, Zwerling has operated it hands-on as a conservative-leaning news-talker featuring a carefully crafted balance between local programming with a parade of hometown personalities (including local superstar Dave Michaels) and a menu of leading syndicated talent. Carr: Equal Time Rule Wasn’t Being “Misconstrued on the Radio Side”

According to a piece in The Hollywood Reporter, the Federal Communications Commission’s recent Guidance on Equal Opportunity Issues was pointed toward broadcast TV license holders and not radio is because, as FCC chairman Brendan Carr states, “There wasn’t a relevant precedent that we saw that was being misconstrued on the radio side asimg that wasn’t part of anything in that decision. It was focused on the potential misreading of precedents on the broadcast TV side. Of course, as you know, the rule applies to broadcast, radio and TV, but that one was focused on those TV precedents.” The memo to broadcast TV was relative to the 1996 bona fide news interview exemption that came about in the wake of an interview Jay Leno did with then-California Governor Arnold Schwarzenegger on “The Tonight Show.” The FCC Media Bureau ruled that “The Tonight Show” did not have to give Schwarzenegger’s opponent equal time because that interview segment qualified as a bona fide news interview. This matter doesn’t seem to be a big one for news/talk radio since news/talk stations are viewed as news outlets, on top of the fact that most talk radio hosts would love the opportunity to interview candidates with whom they might not personally agree. Audacy Announces Programming Changes for “ESPN 1320” in Sacramento

Audacy’s Sacramento sports talk outlet KIFM-AM “ESPN 1320” announces a new programming lineup that will take effect next Monday (2/2).  A new morning program called “The Jump” and starring Kyleimg Madson and Jesse Tapia airs live from 7:0 am to 9:00 am with a replay airing from 12:00 noon to 2:00 pm the same day. The station notes that this is Tapia’s first on-air role and that he’ll continue producing the “D-Lo and KC” show. That program, starring Damien Barling & Kenny Caraway, is moving to the 2:00 pm to 6:00 pm daypart. The station adds that James Ham is expanding his role as the Sacramento Kings insider as he’ll provide breaking news updates and analysis weekly on “The Jump” and “D-Lo & KC.” Station brand manager Kyle Madson says, “Jesse brings a wealth of knowledge and enthusiasm for sports, and we’re excited to evolve our lineup with the launch of ‘The Jump,’ bringing high-energy to Sacramento mornings. By moving the unmatched wit of D-Lo & KC to the full afternoon drive and having James as our Kings Insider across all shows, we’re doubling down on the local insight and personality that defines Northern California sports radio.”

A 20th Century Rulebook Officiating a 2026 Game

imgEvery media creator knows this moment. You are building a segment, you find the clip that makes the point land, and then the hesitation kicks in. Can I use this? Or am I about to invite a problem that distracts from the work itself?

That question has always lived at the center of fair use. What has changed is not the question, but the context around it. Over the past year, two federal court decisions involving AI training have quietly clarified how judges are thinking about copying, transformation, and risk in a media environment that looks nothing like the one for which these rules were originally written.

Fair use was never meant to be static. Anyone treating it as a checklist with guaranteed outcomes is working from an outdated playbook. What we actually have is a 20th century rulebook being used to officiate a game that keeps inventing new positions mid-play. The rules still apply. But how they are interpreted depends heavily on what the technology is doing and why.

That tension showed up clearly in two cases out of the Northern District of California last summer. In both, the courts addressed whether training AI systems on copyrighted books could qualify as fair use. These were not headline-grabbing decisions, but they mattered. The judges declined to declare AI training inherently illegal. At the same time, they refused to give it a free pass.

What drove the analysis was context. What material was used. How it was ingested. What the system produced afterward. And, critically, whether the output functioned as a replacement for the original works or something meaningfully different. Reading the opinions, you get the sense that the courts are no longer talking about “AI” as a single concept. Each model is treated almost as its own actor, with its own risk profile.

A simple medical analogy helps. Two patients can take the same medication and have very different outcomes. Dosage matters. Chemistry matters. Timing matters. Courts are beginning to approach AI the same way. The same training data does not guarantee the same behavior, and fair use analysis has to account for that reality.

So why should this matter to someone deciding whether to play a 22-second news clip?

Because the courts relied on the same four factors that govern traditional media use. Purpose. Nature. Amount. Market effect. They did not invent a new test for AI. They applied the existing one with a sharper focus on transformation and substitution. That tells us something important. The framework has not changed. The scrutiny has.

Once you see that, everyday editorial decisions become easier to evaluate. Commentary versus duplication. Reporting versus repackaging. Illustration versus substitution. These are not abstract legal concepts. They are practical distinctions creators make every day, often instinctively. The courts are signaling that those instincts still matter, but they need to be exercised with awareness, not habit.

The mistake I see most often is treating fair use as permission rather than analysis. Fair use is not a shield you invoke after the fact. It is a lens you apply before you hit publish. The recent AI cases reinforce that point. Judges are not interested in labels. They are interested in function and effect.

Fair use has always evolved alongside technology. Printing presses, photocopiers, home recording, digital editing, streaming. AI is just the newest stress test. The takeaway is not panic, and it is not complacency. It is attention.

If you work in the media today, the smart move is to understand how the rulebook is being interpreted while you are busy playing the game. The rules still count. The field just looks different now.

LOOKING AHEAD to the Second Half of the Third Decade of the 21st Century

imgWith the conclusion of 2025 at hand, we are entering the second half of the third decade of the 21st century.  It will be a remarkably transitional period for the talk radio industry and its closely associated fields in talk media, as well as media-in-general.

Here’s what’s going to happen:

The age old “radio station” paradigm as a brick-and-mortar business/cultural/communications center will disappear.  After more than a century, it will be financially and physically impractical to operate the process of “radio” as a federally licensed production company tethered to a broadcast tower that houses programming, sales, and a roster of creative practitioners under one roof on an employee-based payroll. Radio “stations” will be more of an esthetic meme than an actual physical place on a dial coming from a specific business space with desks and “departments.” Programming and sales – local, regional, and national – will be provided by “outside” sources.  Most “talent” will operate as either independent contractors or employees (or “partners”) of these outside companies.  Local-ness and/or national-ness will not depend upon actual location of sources but rather focus of content.  The biggest challenge facing radio station owner/operators will be to transition their “media station” brands from being licensed entities to effectively competing in the “dark jungle” or “high seas” of unlicensed platforms… without going broke.

In the wider world of media:

AI is going to put “Hollywood” out of business.  Oh, there will still be a nebulously geographic place in Southern California called “Hollywood” but it will no longer be mythically based on big studios, production companies, and star talent.

And lovers of freedom will come to recognize the communications arm of “Big Tech” as the greatest threat to liberty facing humanity since World War II.

Report: FCC Scrutiny of KCBS Forced Changes in News Coverage

A report in the Los Angeles Times details KCBS-AM, San Francisco’s brush with the FCC in the aftermath of its reporting the movements of ICE agents in the Bay Area. The LA TimesByron Tau writes, “KCBS radio reported on immigration agents in unmarked vehicles, drawing conservative backlash and a federal investigation from FCC Chairman Brendanimg Carr. Facing regulatory scrutiny, the San Francisco Bay Area station demoted well-regarded journalists and sharply curtailed its political coverage for months. As pressure has eased, KCBS has gradually resumed more ambitious reporting, reflecting tensions between regulatory oversight and editorial independence.” Carr accused the station of failing to operate in the public interest and threatened an investigation. This was enough for Audacy management to back off its reporting. Tau writes, “KCBS demoted a well-liked anchor and dialed back on political programming, people said. For months, reporters were dissuaded from pursuing political or controversial topics and instead encouraged to focus on human interest stories, according to the current and former staffers.” The piece notes that anchor Bret Burkhart, the one to first present the ICE actions on the radio, was demoted. Price to Lead Cumulus Media Stockton-Modesto

Cumulus Media names Jeremy Price vice president and market manager for its Stockton-Modesto,img California station group that includes sports talk KESP-AM and five music brands. Price most recently served with Alpha Media prior to the Connoisseur Media merger in Bakersfield. Connoisseur Media to Sell 15 Missouri Stations

Just a day after announcing that it is selling its three-station Bakersfield, California cluster to local operator Frequency Broadcasting, Inc, Connoisseur Media announces that it is entering into an agreement to sell its 15 radio stations in Missouri to Carter Media LLC and Carter Media Too LLC. Carter Media is based in Carrollton, Missouri which is about halfway between Kansas City andimg Columbia. The stations are in small markets and include: KAAN-AM/FM, Bethany; KWIX-FM, Cairo; KKWK-FM and KMRN-AM, Cameron; KIRK-FM, Macon; KTCM-FM, Madison; KRES-FM and KWIX-AM, Moberly; KJEL-FM and KBNN-AM, Lebanon; and KFBD-FM, KOZQ-FM, KJPW-AM, and KIIK-AM in Waynesville. Connoisseur Media founder and CEO Jeffrey Warshaw says, “These Missouri markets did not fit into our long-term plans. We are pleased to have found a trusted buyer in Miles Carter and his family-oriented company.” Carter comments, “We have wanted to expand for a while and when the opportunity came, we were eager to talk with Connoisseur. As we look toward the new markets, our mission remains the same: bring trustworthy local news, agriculture coverage, and community-focused storytelling to areas that need a stronger voice. Vicky Moore Exits KNX-AM/FM Los Angeles

After 22 years as a news anchor on Audacy’s all-news KNX-AM/FM, Los Angeles, Vicky Moore left the station last Friday. During her on-air farewell, Moore stated, “I really love radio. Because radio is about community. At a time when the phone in our pocket and in our hands right now creates distance between us, and the politics divide us, the AI make us questioning what is real,img people here at KNX all around me are real. Connoisseur to Sell Bakersfield Cluster

Connoisseur Media enters into an agreement to sell its Bakersfield, California radio stations to local operator Frequency Broadcasting, Inc. The station group includes news/talk KNZR-AM/FM, CHR KLLY-FM, and rhythmic oldies KKBB-FM. This transaction is pending regulatory approvalimg by the FCC and is expected to close early next year. Connoisseur Media says the sale is “another step in the company’s efforts to concentrate on markets where it can execute its successful playbook. It is one element in the strategic plan for the markets acquired in Connoisseur Media’s acquisition of Alpha Media that took place in September.” Connoisseur Media founder and CEO Jeff Warshaw says, “Bakersfield was a market that did not fit into the long-term plans we have for Connoisseur. We looked for a local operator that we felt could devote the time and energy that Bakersfield deserves. We are confident that we have found that in Frequency and the Hill family operation.”

10th Music Industry Reunion “The Best Ever!”

Last Wednesday’s 10th Annual Music Industry Reunion in Calabasas, California brought together more than 170 of the industry’s finest, according to organizers Jon Scott and Kenny Ryback, making it the “best ever.” The gathering saw radio, record, artists, managers, producers, lawyers, legends and pros flock to the Sagebrush Cantina. Scott and Ryback say, “While mini-reunions of KLOS, KTYD, KROQ, TEN-Q and other radio stations flourished, clans from A&M, MCA, WB, EMI/Capitol Records, Casablanca Records and other labels met up and swapped war stories from ‘back in the day.’ They are thankful to sponsors Technotainment, Rockaway Records, and The Hollywood Show for their support.

Fair Use in 2025: The Courts Draw New Lines

imgImagine an AI trained on millions of books – and a federal judge saying that’s fair use. That’s exactly what happened this summer in Bartz v. Anthropic, a case now shaping how creators, publishers, and tech giants fight over the limits of copyright.

Judges in California have sent a strong signal: training large language models (LLMs) on copyrighted works can qualify as fair use if the material is lawfully obtained. In Bartz, Judge William Alsup compared Anthropic’s use of purchased books to an author learning from past works. That kind of transformation, he said, doesn’t substitute for the original.

But Alsup drew a hard line against piracy. If a dataset includes books from unauthorized “shadow libraries,” the fair use defense disappears. Those claims are still heading to trial in December, underscoring that source matters just as much as purpose.

Two days later, Judge Vince Chhabria reached a similar conclusion in Kadrey v. Meta. He called Meta’s training “highly transformative,” but dismissed the lawsuit because the authors failed to show real market harm. Together, the rulings show that transformation is a strong shield, but it isn’t absolute. Market evidence and lawful acquisition remain decisive.

AI training fights aren’t limited to novelists. The New York Times v. OpenAI case is pressing forward after a judge refused to dismiss claims that OpenAI and Microsoft undermined the paper’s market by absorbing its reporting into AI products. And in Hollywood, Disney and Universal are suing Midjourney, alleging its system lets users generate characters like Spider-Man or Shrek – raising the unsettled question of whether AI outputs themselves can infringe.

The lesson is straightforward: fair use is evolving, but not limitless. Courts are leaning toward protecting transformative uses of content—particularly when it’s lawfully sourced – but remain wary of piracy and economic harm.

That means media professionals can’t assume that sharing content online makes it free for training. Courts consistently recognize that free journalism, interviews, and broadcasts still carry market value through advertising, sponsorship, and brand equity. If AI systems cut into those markets, the fair use defense weakens.

For now, creators should watch the December Anthropic trial and the Midjourney litigation closely. The courts have blessed AI’s right to learn – but they haven’t yet decided how far those lessons can travel once the outputs begin to look and feel like the originals.
